I got my citizenship half a year ago through marriage after 3 years of residence. I am divorcing my American husband now. I am in love and am going to bring my fiancee with K-1 visa here in the states.

When I was reading instructions for K-1 visa, I dind't find anything there regarding any limitations for bringing a foreign fiancee. Like there is for bringing a husband - you van only do so if your residence is 5 years old minimum.

So, did i get it right or not? Can I file K-1 visa petition for my fiancee if my residence in the US is only 3 years and 9 months old?

I have not come across a minimum number of years restriction for citizenship for I-129fs for K1s. It doesn't appear to be mentioned in requirements for filing (just that one must be a citizen).

The basic requirements are:

* Both parties be free to marry

* Must have met face-to-face within the 2 years prior to the filing of the petition

* Are able and willing to marry within 90 days of entry on the K1 visa

Not passing judgement - but it struck me as a potential red flag that you're seeking to bring a fiancé over almost immediately after obtaining your citizenship. You may want to think about that when you're putting together your relationship evidence. Is your fiancé from your country of origin?

No, it's a person not from my native country, and we met over the Internet quite recently. Yes, I understand all the possible suspicions our relationship may cause, but the main thing is that my first marriage was of love, as well as my current relationship is true and genuine love. It just can wear out, if someone you love betrays you, like my American husband did.

You are now a US citizen. You can file the I-129f for your fiancé, there is no residency requirement. The requirements for filing the I-129f are:

• Petitioner must be a US citizen
• Both Petitioner and Beneficiary must have met in person within the last 2 years
• Both Petitioner and Beneficiary must be legally free to marry, and willing to do so within 90 days of the Beneficiary's arrival to the US.

It may raise a red flag that you are divorcing your husband shortly after becoming a citizen, and now are petitioning someone new. However, just be honest about your situation and explain everything and I'm sure you will be fine. Good luck!

IMO, it's not relevant to your petition. With that being said, come interview time, your fiance should probably be prepared to answer any and all questions surrounding the circumstances regarding your failed marriage.

I am wondering if USCIS is prejudice to petitioners like me - the ones who got citizenship through marriage?

I wish I could talk to the other people with the same background and see if they were approved or denied, and how their process went...

No, not required for USCIS. If you are legally divorced, then the only "splaining you needed to do is to the divorce judge.

Looks like your good to go with the K-1.

It's not to say that the "issue" as raised by others won't be brought up....most likely during the interview.

You are a new citizen, having come over on a K-1, and your relationship timeline shows that you engaged in another relationship while still legally married......now is where your particular case and history comes into play. Make sure that your fiance has all the information and you two need to show a legitimate relationship with the intentions to stay in the US, marry and stay together forever.

You may want to write a letter describing your past and how your new relationship came to pass and is not part of a bigger "plan".

After some time I started thinking my situation is not that suspicious - I got my citizenship in August 2013 and the big fight with my husband,

that triggered my new relationship only happened in October 2013. Had I had a "big plan" in my mind, I would have probably divorce him right after getting my naturalization certificate.

My "timeline" looks like the following:

August 14th 2013 - citizenhsip

October 25 2013 - big fight with the husband and meeting my sweetheart over the Internet. I was actually thinking if this life was worth living, but he brought me back to life.

January-February 2014 - meeting my sweetheart in person, while I went on vacation. During this meeting I made the decision I want the divorce.

February 19th 2014 - divorce filed. Still waiting for the hearing date Though all the petition papers have been prepared, just waiting for the divorce decree to be added.

So, what do you think, guys? Especially, what would you think if you were a USCIS officer?
