Hi All - So I have not filed my 2013 taxes yet because we are waiting for my husband to have his interview. I can't file our taxes without his passport, but it is illegal to mail passports overseas so I was going to do an extension and file when he arrives. If his interview is after April 15th are they going to ask for 2013 taxes? I am sending the AOS form with 2012 being the most current.

We are sending our AOS next week without the 2013 tax transcripts. We are sending only that of 2012. USCIS, will only request for 2013 when they need it and of course by which time your 2013 transcripts would have been in to send to them. It doesnt hurt at all

Taxes done or extension is fine since its that time of year. Extension no problem. I would however make sure your husband had copy of 2013 W2 just in case and current of course

Thank you. I have my W2 for 2013 so I will make sure my husband takes that. I was going to file, but I would have to request an ITIN for my husband and people are telling me it's illegal for my husband to mail me his passport. :(

Yes you are so close better to file extension and make sure he has that form that you filed for extension (Free on turbo tax). izzy pizzy.

And yes a no no to mail passports. You are almost there wooo whoooo.

I didn't mail my passport but I had the US Embassy here make a copy of my passport and do a "seen and compare". They stamped the copy and signed it and on the stamp it said "for IRS and ITIN purposes only". That's what I sent to my husband with my W7 form, a signed 1040EZ and a cover letter with my signature. Should be good enough to allow him to file MFJ.

Look into the same process with the USEM in your country. And read the W7 instructions. It outlines the different documents they accept for foreign ITIN applicants.
