Can someone tell me what I need to do to get a green card for my girlfriend living in Japan? She is 19 years (will turn 20 next month) and has a father who owns a business and has a green card in Florida. I live in Seattle and she wants to live in Seattle and work here as an airline attendant. We talked about marriage but this is not going to happen until I get to know her fully.. I hope to get some leads. I heard of the form I-130 and seems like its the right form but questions I have is.

1. Is this fastest way for her to get the green card?

2. How long will this process take (I have been told It takes 5 months for just processing time.. and usually takes 1.5 years.. (quite long) but wondering more accurate time frame?

3. Other ways of obtaining it through her father?

4. Any restrictions in Japan I should know about?

Arigatou Gozaimasu! haha

If she is below 21, she can get it through her father within exactly same process she would get through marrying you... Caution needs to be take though for her not to age out (exceed 21) as then wait is much much longer. He can simply petition her through I-130.

Under CSPA she will be able to deduct the processing time of the I-130 from her biological age to arrive at her CSPA age; this may assist in preventing her from "aging out".

Her father should file the I-130 immediately.

There is only one way for her to get a green card - through her father.

The only way you can help her get a green card is to marry her.

Her father filed an I-130 to start the process. This would be an F2a case where the PD has not moved for 3 months and is not expected to move any time soon.

It normally takes about 2-3 years to get a visa in the F2a category.

Here is the problem - your girlfriend will turn 21 during the wait so she will age out into the F2b category where it takes 8 years for a visa.

CSPA may help her to retain the F2a category. There is no way to predict if this will help her or not. It all depends on when USCIS approved the I-130 and when her PD becomes current.

So it's 2-3 years if she is lucky enough to retain the F2a category. It's 8 years if she ages out into the F2b category and CSPA does not help her.

Essentially, she is unlikely to move to Seattle anytime soon.

Her quickest way to the US is to marry a USC. This takes about 12-18 months.
