attending college classes while waiting on AOS

Hello everyone!!!

Can my husband attend a few weeks of vocational school while waiting on his AOS? He wants to study his nursing here and wants to get started on the classes but I want to make sure everything is legal. We should have AOS card in the mail in a few weeks.

HELP!!!!!

No. he can NOT. Just because he is non-status person now. He is not under student visa and not resident yet. We tried too and were said in all places that green card needed. So only next semester.

I think the question was whether it was legal for him to do so before the USCIS, his acceptance at a school being implied. If a school were to accept him he would not be outside the legal realm of his AOS.

Yes, legally he can attend school as long as he is in the US legally, which he is. (You can even attend classes if you're on a tourist visa, in many cases.) It may be difficult, as other posters have said, because he won't meet the residency requirements for all schools and may need to apply as a "foreign student" which will mean his fees will be even more expensive.

Some schools may be able to waive the residency guidelines under the assumption that he will become a legal resident at some point during his time at the school. You never know. It's definitely worth asking!

I hope he gets to go to school and get a headstart on his new career in the US! Good luck!

Just saw this. Ohio has this thing called immediate residency for tuition purposes. If your spouse is employed on a self-sustaining basis (i.e. you and your spouse don't receive money form people or organizations outside your state) in Ohio you're eligible for in-state tuition. Worth it to check out whether your state has something like that.
