If you live abroad you send it to the chicago lockbox.. Your lawyer is telling you need to send it via where you intend to live, or you did file it through Texas?

20th Mar 2014- Cased shipped to NVC.

13th June 14 Supervisor review, said she would remove it when spoke to her. (Up to 30 business days).

28th July 14 CASE COMPLETE!!!!

5th September 2014- Interview @ London

05th Sep 2014-Interview

05th Sep 2014- APPROVED! Visa Status Issued same day!

10th Sep 2014- Visa in hand

18th September 2014- POE ORLANDO FL! DISNEY!! :dancing:

Everything I see says my petition should've been sent to the Chicago lockbox (we live in Japan) my lawyer said I sent it go Texas because that's where I intend to live!!! Are we screwed??

Did try to read I-130 instructions ? They clearly say where petition should be sent to - there are two service centers depending on state you live in and none of them is Texas. So yes, you're screwed but mainly because you hired a lawyer that has absolutely no idea what he's doing and doesn't even read most basic instructions.

(Btw - yes, it's Chicago for people living outside US).

Yes! It is so clear that if should be sent to Chicago!! We live in Japan!! I asked him why he sent it to texas and this was his reply!

"You mail it to Phoenix because that is where they process the payments. The service centers don't have cashiers. After they process the payments the file is sent to the respective service centers and in your case Texas as that is where you are planning on residing (question on your I130).

Believe it or not I have been doing this for ten years and i do know what i am talking about."

He tells me texas.. I question him ANC he says Phoenix!!! My lawyer is an idiot! What do I do??

#1 Fire that lawyer. #2 Show him the paperwork on the I-130 instructions that he's clearly wrong and hopefully get your money refunded.

Has USCIS kicked back your petition? Did they send it back to you or your lawyer?

Some people advise me to be patient and texas or Phoenix or wherever he sent it will send it to the appropriate place... I think I should cancel the checks to homeland security that he sent and send out a new petition tomorrow morning to the Chicago lockbox..., any opinions?

This is just my opinion, but if your lawyer doesn't even know the proper place to send the petition, I would highly question his abilities throughout the rest of this process.

If you have a pretty straightforward case, you might not even need a lawyer. But I don't know your situation and certainly can't give advice one way or the other, but I've read on here about lawyers screwing people (and a lawyer gave my husband and I bad advice in the early stages - we were stupid in following that advice).

I hope USCIS forwards the petition to Chicago and doesn't reject it. Good luck! :-) I don't know if you should cancel the check, you may have to wait and see what USCIS does first?

I agree with above. Sending petition is really straightforward thing to do, if he can't do that right, I would be worried it will only get worse.

I completely agree with this. I wouldn't trust the lawyer's abilities if he doesn't even know the correct place to send the petition. And barring any complex situations, you are much better off without a lawyer. The process can be lengthy but is usually very straightforward.

Also, there is no need to cancel the check. Either the petition will be accepted and forwarded, or it will be returned with the check.
