Hello I am in the process of sending application to adjust my status. I married to an American, we have almost everything... But if am confused about few things, any help would be much appreciated.

  1. How many passport pics to I really need to send
  2. Does he need to send 3 years of tax returns? We filed 2013 together and he has 2012
  3. We have bank account together and filed married joint 2013 would that be proof enough? We are planning on getting car insurance and bills together prior to interview.
  4. I no longer have my I-94 I came to US about 14 years ago and lost, but my passport has the immigration stamp with entry, would that be good?
  5. If he sends last 6 month of his pay stubs do he still need employment verification?
  6. Do we need send pictures of our wedding and with family and friends, or only at interview, I see that a lot of people send photos and letter explaining how they met, first dates and things like that..

Thank you very much!

  1. How many passport pics to I really need to send --> I attached TWO of mine with each form (TWO for spouse as well)

  2. Does he need to send 3 years of tax returns? We filed 2013 together and he has 2012. --> I posted this question on AVVO and some lawyers suggested STRONGLY to mail past THREE years of tax return

We have bank account together and filed married joint 2013 would that be proof enough? We are planning on getting car insurance and bills together prior to interview. --> For now, this should be ok but for the interview, try to get as much stuff together as possible

I no longer have my I-94 I came to US about 14 years ago and lost, but my passport has the immigration stamp with entry, would that be good? --> Thats a tough one, I would search this site for what other people have done

If he sends last 6 month of his pay stubs do he still need employment verification? --> They say with 3 years of tax return and pay stubs, it should be good enough

Do we need send pictures of our wedding and with family and friends, or only at interview, I see that a lot of people send photos and letter explaining how they met, first dates and things like that..--> I didnt send any letter explaining as to how we met but I did send pictures of our wedding and honeymoon.

For AOS, it is 6 total photos for JUST the beneficiary. (2 for I-485, 2 for I-131, and 2 for I-765) NONE of the petitioner. The only passport photo the petitioner submits is with the I-130, where it is 1 for the petitioner and 1 for the beneficiary. Don't waste money on extra unneeded passport photos.

OP, I would possibly get some affidavits and maybe a rental or lease agreement drawn up to show domicile for your interview as well. Most people send in a few photos with their application and bring their large haul to the interview. A letter explaining how you met etc is redundant because those are all questions you'll be asked at the interview.

Past 3 years of tax returns and employment verification are not required however many people send them in because it builds more for their case and less likely to receive an RFE since the I-864 always seems to snag people. You have 6 months worth of pay-stubs though so it's not an issue if you opt to not submit a employment letter but I'd recommend ordering tax transcripts online for free from the IRS, they arrive usually in 5 business days and it might be worth it in the long run, unless you have all the paperwork from your last 3 tax returns. Tax transcripts are just so much easier to work with and you don't need to attach any W2s.

Good luck.
