I am a U.S. citizen and my husband is a perm. resident...can we bring his brother to the U.S?

Timeline

Hello all! I am back with another dilemma...my husband wants to bring his 15 y/o brother to the U.S. to live with us. My question is, how long does the process take? What type of documentation and what forms do I need to fill out? :thumbs:

Appreciate any help I can get on this subject...thank you and Happy New Year everybody!

Petitioning Procedures: Bringing a Sibling to Live in the United States

This information is for a United States (U.S.) citizen, who is at least 21 years of age, who wishes to petition for or “sponsor” his or her brother or sister to live permanently in the U.S. Lawful permanent residents are not eligible to petition for a brother or sister.

1) Your husband needs to become a USC before he can petition for his brother. Then he can file the I-130, etc. and wait for a visa number.

You will be notified by the USCIS if your I-130 petition is approved or denied. If it is approved, your brother or sister will be notified by the Department of State when a visa number is available. If your sibling is outside the country, he or she must then go to the local U.S. consulate to complete visa processing.

2) The last time I checked it was something like a ten year wait for a visa number to become current for a brother of a US Citizen.

I didn't look to see how long you've been married, but if your husband was intending to pursue citizenship at the 3 yr point anyway, I think he could then file a 130 for his mom and/or dad. Their paperwork would be on about the same timeline as any spouse petition and if they wanted to they could bring their child(ren) with them.

That's right. GCs for parents are faster than brothers. Depending on the country, bringing a brother/sis could take up to 10 - 15 yrs... Bringing parents is faster. They can come and bring any unmarried child younger than 21 yrs. old. There you go! The parents can come back to the country of origin if they wish after that.
