Hello VJ, loooong time no see! I have been procrastinating checking in here to look for the info I need because I am so scared of what I will need to do or pay. Gosh, I'm so bad.

Here goes. But please, be gentle. Don't be so hard on me and scare me. Every issue has a solution, right?

In 2008 I received my k1 visa and entered the USA and married my husband. We were in California for three years. During this time, I visited Vancouver three times for about a week each time, staying at hotels. During this time we had two children. In 2011 we moved overseas for my husband's job, and had one more child. During this time, I visited Vancouver once for a few weeks. All visits were just visits.

I closed my main bank account sometime in 2008. I let my Visa card expire. My bc driver license expired last year. I got my California driver license sometime in 2010. My husband's accountant has been filing all our taxes in San Francisco, and now overseas. I became a USC before we moved overseas.

The last time I filed my Canadian income tax was in 2007. I didn't file 2008's because I left in March 2008. I did not notify ccra or MSP I was moving abroad and not returning. Was I supposed to? Please don't tell me I'm red flagged and owe thousands of dollars to MSP and rev canada...We are most likely never going to live in canada again, until we retire or if we decide to purchase a vacation property there years down the road.

I'm so nervous I don't know what or who or how I should contact! Please, be gentle!

Canadian income tax is based on residency, unlike the us, where it's based on citizenship. As a non resident, you don't owe canadian taxes, unless you had a canadian business or investments in Canada making money. You don't need to even file anything - you could file for 2008 just to get it on the record that your residency ended in March of that year.

There's also a newish legislation where you can voluntarily come forward and file back taxes with no penalties.

Deep breaths. This is not a big deal!

Yes unlike us who are the only nation to be screwed over when we aren't residing in the US with taxes. Canada tax is so easy compared to here, and only based on residency. Wish people would stand up here and try and change that stupid law we have here about filing taxes if we don't live here anymore...

Did you have any Canadian income in 2008 before you moved in March 2008? You may need to file 2008's but that's probably about it. Did they deposit any of the credits like GST/PST/HST or Child tax credit into your bank after you left? If yes you probably have to pay those amounts back becuase once you moved you were no longer entitled to them.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Pretty much as long as you don't owe them money for 2008 you are good to go. I didn't bother filing when I left as I had no income they told me it wouldn't matter since I don't owe and I wouldn't get anything back either.
