I am getting ready to file AOS forms, I have a couple of questions. If I dont have any certain dates to travel out of the US, can I still file for AP and use it at my convenience?

Is it recommended to file this with the entire package, any problems with reentry, and can it be used more than once as long as its valid?

Thanks

G

No you don't need specific dates. you can give a general time frame like June 2014 or summer 2014, etc. Also, yes apply for AP when you submit the AOS as you never know how long it will take to get your greencard approved - some people get approval quickly if they have an interview and others that are interview waiver cases can take a year, so it is nice to have the AP card incase you want to travel. Yes it can be used more than once as long as it is valid.

Leave the date and length blank and then hand0write Unknown for those two fields after printing out the form. Yes, you check the box for more than one trip. Also, no reason/explanation needs to b given when applying with a pending I-485.

Yes. Include a copy of the I-485 receipt from filing for AOS, and there will be no fee for the I-131 still.

We just got her EAD and AP the other day and it is one card (like a photo ID) and it is good for one year. If you file for these with your I-485 it is free, if you wait to file for EAD and AP later you have to pay to file them. Good Luck!

Incorrect. See what I said above your post. The fees for the I-765 and I-131 are waived when filed with a pending I-485. The fees are waived if you file for them together or if you file for them after you have filed the I-485. You just need to send a copy of your I-485 receipt notice when applying and the fees are still waived because you have an I-485 pending. See the info from the actual USCIS website > http://www.uscis.gov/i-485

I just filed my I-485 together with AP and EAD. I did some research on this forum and this is what I included both with my I-131 and I-765:

- 2 passport photos

- copy of passport (bio page, visa page and stamp)

- copy of marriage certificate

- copy of NOA2 of I-129F

- copy of I-94.

Don't really know if that was necessary, but I'm trying to avoid any RFEs here. Knock on wood. Also I heard, that the I-485 gets separated and processed differently than the I-131 and I-765. Don't know whether this is true or not.

Hope this helps!

Hello,

Can anyone else confirm that the dates do not have to be specific on the AP application? or what if I put dates down, but then the dates change and need to travel at a little different times than what was in the application? whill this be a problem?

Is the EAD and AP the same (one) card? or are there two different documents that will arrive in mail?

Since Feb 2011, the EAD and AP typically come as a combo card. http://www.uscis.gov/news/questions-and-answers/uscis-issue-employment-authorization-and-advance-parole-card-adjustment-status-applicants-questions-and-answers

It will not matter if your dates change. You can even leave the dates blank or hand-write Unknown in those fields after printing out your form.
