I am US Citizen. I applied for I-30 and I-485 for my wife. She just got her work authorization card. My job is asking me take a overseas position that would require me to out of the country for 2 years. Can my wife come with me and she come here when she gets her interview??

in other word how this will be affecting my wife??

Yes, this will affect your wife. A greencard is for your spouse to reside here is the USA. Since yo will be living outside the USA for an extended period, there is the issue of abandonment of the greencard. Being that she has not even gotten her greencard and she will already be living outside the states,Mathis will be an issue.

Will you be leaving before she gets her green card?

we submitted the required papers in Nov 2013. So lets say the process to get the green card takes 9-12 month, i would have to leave for new position in 4 month (June-July). She might not have the green card by then. So yes, but we can come back when we get the interview, no problem. Would that be okay??

Also I would have flexibility coming back to the states anytime i want. so this means that i do have to be out of the country for complete 2 years. I can back for a visit every 6 month

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

If she has advance parole then she could leave the country for a short trip and you could both return for the interview but if your intention is for her to reside with you for the 2 years then you would be better off abandoning the GC application and reapplying once you both intend to actually reside here.

No, it's not okay.

The reason to grant her a green card is because you live in the US. You have to have a US domicile.

No reason to give her a green card if you are living in a foreign country.

Thank you guys for replying. Yes, she does have advance parole.

I know people that have green card and reside outside the US and they just come and visit every 6 month and no problem

So please i need definite answers, no personal opinion please.

As a Note: I am going on a especial assignment for 1 year. So after asking around, i have been told it is not an issue. Now i am seeking a legal advice, which will assure me which way should i go with
