Hi,

If I came in on a K1 visa last year, got EAD in Nov but had no employment do I need to file a tax return?

01-09-06 Interview Date (9am) We were not approved today, I guess we got a 221g of the damn S. Korea Police Certificate that Casablanca said we didn't need.

03/15/06 Visa Issued

03/31/06 Enter USA via JFK

05/15/06 Wedding for Visa

06/10/06 Mailed AOS papers

07/06/06 Biometerics Apt

07/15/06 My offical wedding day....I know .....:-)

Exactly. As long as the OP and his wife were legally married on or before December 31, 2006, for income tax purposes they generally have the option of being deemed married for that entire year. This effectively doubles the OP's tax deduction and, since the wife had no taxable income in '06, reduces their overall tax burden.

8/16/06 Overnighted AOS and AP applications (no EAD, since I won't need it until next year).

8/17/06 Delivered at 12:44pm (Chicago lockbox).

8/24/06 All 3 checks cashed.

8/26/06 Received NOA. I485, I130 and I131 are online.

8/29/06 All 3 touched.

9/2/06 Biometrics appointment received.

9/5/06 I130 and I131 touched.

It's not an option. Your marital status as of the end of the tax year is your marriage status for the purpose of filing taxes, no choice about it. A married taxpayer is not allowed to file as single. If married, you DO have an option about whether to file a joint return or file separately.

There's also an option for the foreign spouse to be deemed a resident for the entire year even if not present the entire year. That's absolutely correct. The word "option" in my post was supposed to refer to the decision to file individually/jointly and for the foreign spouse to elect to be treated as a US resident for the entire year for tax filing purposes. My post, of course, didn't say any of that :)
