Kaelabelle, thanks for the link. I truly hope the I130 times can get resolved.

Just my opinion and certainly nothing personal against you or about your post, but It seems that once a month there is at least one petition created, and every time it dies without reaching it's goal.

For the people who want to pursue the petition route, I think just 'signing and sharing' is not effective. Maybe in this petition(or the next one), we try something else and hopefully it gets better traction.

1) I would change the wording and description. Someone already stated, but outside the visajourney circle, no one knows what an I130 is. The description needs to be more personal and in layman terms, explain the hardship.

2) The petition states that it takes 10+ months to be approved. Again, to us in the VJ world, that's terrible. But to everyone else(who are most likely U.S citizens and are not going through this), they might think that is part of the "government procedure." They don't know better(because they aren't exposed to it, and they don't have a vested interest). Maybe in addition to talking about emotional hardship, we also need to talk about the delays and customer service. USCIS goal is 5 months and for a time, they were able to meet it. In 2013, things started to fall apart...and the punch is the stomach is that nothing is being done for 1 year. Talk about the discrepancy in customer service, talk about the inconsistency in the order, talk about the 3 or 4 different timelines that we look at. 60 days, vs the bar graph, vs the PD date, etc etc.

believe it or not, not everyone will agree that 10 months is a 'delay.' its subjective...especially for people who are complacent about the way the government works. But...what is more universal is: poor customer service, identifying a problem and not fixing it, giving contradicting information... etc

3) for the ones who are sharing the link via Facebook, twitter, linkedin etc, the point of this is to get our friends to help. But if we are just pasting a link without context, our friends don't care (and they shouldn't have to care). Paste the link, write your own personal story and how this personally affects you, make a video, do something. Your true friends, the ones who want to help, should sign it, because they want to help you.

The reason that the justin bieber petition gets signed and this doesn't is because everyone can relate to justin bieber and have reason to hate him (whether it's valid or not). For this to work, we need people to understand the situation with better context and have a reason to want to help you(personally)

The only way to get this moving is to file a class action against the Obama administration. A court case with the petitioners being US citizens who rights are being violated because of Obama's executive order DACA is the best way to go. It's an election year and immigration is a hot topic. The court case will get huge media attention.

We'd have no basis to sue. If we're going to complain to anyone, it has to be to the USCIS and our representatives in government. It's the USCIS that chose to process the DACA filers instead of us.

Do you know your rights under the US immigration law? Do you understand US citizens petitions filing for their immediate relatives legally are supposed to come first over all petitions. Do you understand Obama's DACA executive order is illegal because it is unconstitutional. Do you understand what is happening to our petitions is illegal? What do you mean we do not have a case? Please.

I do know my rights under US immigration law. I also understand the way the laws in the US work.

Obama didn't order the USCIS to give DACA filers priority, they chose to do that. How, exactly, is Obama's executive order unconstitutional?

I reiterate, having a class action lawsuit against the president will get dismissed. He has the right to sign executive orders. The government agency that we all applied to decided to process the DACA applications instead of the I130's. If we're going to go after anyone, it has to be against them. And I don't honestly think that a lawsuit would achieve our goals here. I believe that putting pressure on them through the media, and contacting our representatives, and also the USCIS directly will have the best outcome. If you really want to fix the problem, you should focus your energy there. I also think that we should attempt a legislative fix to this problem.

We have looked through all options as there was several who were offended at the blatant political push to create more democratic voters. I understand your sentiment.

He's from Chicago - this is what they do.

Dead voters, inmates, vagabond college students - anybody who will definitively distract from their hard-left agenda.

The man is not beneath devaluing american citizenship for positive electoral outcomes.

The problem is that none of this is unconstitutional.

To a judge, the fact that your spouse is facing an extraordinary delay in getting a visa is an imposition at best.

It's not a violation of the law.

His/her rights were not denied and the fact that he/she is supposed to legally be prioritized but isnt proritized is something that does not qualify for a class action lawsuit.

A governor who wants to protect his state from Obamacare can tell Kathleen Sebelius to take a hike (like Rick perry did)

But you can't do that with immigration - because its solely under federal purview.

Have anybody been paying attention to court cases which DACA has been addressed? Several judges have ruled DACA is most likely Unconstitutional. Obama's Executive Order DACA is unconstitutional because it bypassed Congress. Only congress is supposed to make laws relating to immigration. Giving illegal immigrants priority over US citizens is unlawful. Period. Obama created this mess. His law created the backlog. US immigration law is clear. US citizens who petition for immediate relatives has priority. It's not a policy. Its the freaking law. This what's wrong with this country. Too many people don't know their rights and will accept anything. The immigration laws and not enforcing it is creating problems for US citizens and I will not stand by and tolerate it.

You are referring to Crane v. Napolitano.

That's ONE court case.

Based on that ruling, the most they can accomplish is an order allowing ICE agents to formally initiate removal proceedings against DREAMers they happen to encounter. DREAMers=DACA Applicants.

Once in detention, they can still file DACA for relief.

There's a million lawyers wanting to facilitate that - just fyi.
