I would say 2nd degree in this case too.

No one cares cause the shooter was not white and the race baiters can't make hay out of it

I'll have to read that one. From what you said, I would also consider that 2nd.

He was charged with 1st degree, just like this guy. No valid comparison until we know the verdict.

If you are going to attempt to be smarmy you at least have to have your facts correct. I'm not making comparisons to the two cases for race, only for the first degree charge and the reasoning behind it... But as you are bringing it up: In the other killing I was talking about the girl that was killed was black.. The two men committing the crimes are of different races and both received a 1st degree murder charge (though the second guy did not face charges of firing at the other people in the car).

This works great for those who see racism everywhere: If the second man is convicted it is because the jury is racist and giving a different verdict because he is black. If he walks its because they don't care about a black victim. No matter what the outcome it is racist...

The contemplation has to be before the incident. Getting mad during an altercation should not be counted as premeditated.

It is based on individual acts, not the entire altercation. Read the definition again. Contemplating the act, then taking action is premeditation.

For instance. Murder occurring during the commission of another crime is sufficient to establish premeditation.

Of course it would be for you. You only care because the victims were black and you see this as some sort of on going injustice against blacks. If everyone was white, I'd be saying the same thing, would you?

2nd degree is not self defense FTR.

If this happen to White kids I'd say the exact same thing. Find a case in which this happens to anyone else.

What? Murder? Happens to plenty of people, every day.

Any case where there's a loss of life I've posted and spoke my peace. When was the last time a parent's child killer was convicted of anything except the murder of that child?

Then why even have murder two? There has to be a level to separate out planned deliberate killings and killing out of anger. The first is clearly worse.

I'm aware of that. If he was convicted of any of the above, that would do. But as it stands, he's going to jail for attempted murder, not murder. Meaning that the only reason he's going to serve any time is because he didn't kill the other three teens inside the vehicle.
