Timeline

hi all.....is there anyone else out there who has k2 kids....but who are say nearing the aging out age for aos???..i know of 1 other, which would be girona40, who has been going throu this for a long time with her son.

my son is 20, and WILL STILL be 20 when we file... and as far as we are concerned, that is all that is needed for them to be able to adjust status.....but will turn 21 in april, but we are hearing of other horror stories, like girona40's, of how the son or daughter turned 21 while still in the process , and were denied. are there any more out there who might be in the same predicament?...or does anyone have any thoughts on this?

My son is 20 as well, going to turn 21 soon, so I am in the same situation. Will have to wait and see how our case goes, the paperwork has been filed and accepted, so just waiting to see how it goes.

Hi Deb,

My 2 daughters were on K2 visa. My elder daughter is 20 and will be 21 this January 6, 2007. We applied for AOS (scheduled on-line INFOPASS appointment for the DORA Program: District Office Rapid Adjustment...Dallas District Office) last November 27 at 3010 NORTH STEMMONS FREEWAY, Dallas, TX 75247 and got accepted after we complied with the documents they needed from us, thus we were automatically interviewed the same day.

Girona40 had been a great help because she advised me to put in our application (Cover letter per application: the 3 of us applied altogether): REQUEST EXPEDITIOUS HANDLING OF ADJUSTMENT OF STATUS: K2 AGEING-OUT. However, on top of this, we have another request for expeditious handling because of the Permanent Protection Order (relative to Philippine Republic Act 9262 or Anti-Violence Women and Their Children Act of 2004) we have against my Filipino ex-husband who is based in the Philippines; and if my daughter will be sent back to the Philippines because she ages-out, this will cause emotional distress for all of us since her safety is not guaranteed there.

We were ok with the interview since our documents according to the adjudicating officer are perfect. According to her, we will be called for our biometrics (which my 2 daughters and I had already taken last December 26), wait for the FBI name check (this, according to the officer, we have to pray fervently that they come up with the results immediately...before my daughter ages out....well, we have done our part...submitted the application and had our biometrics before my daughter ages-out) and wait for our green card.

I have also asked the help of Congressman Sam Johnson of the Third District of Dallas. We faxed him last December 18 our authorization for him to look into our case (we gave him the specific details). He sent me a letter that he is interested in our case and have already contacted some people to give him a report and he will update me as soon as possible. The letter was dated December 19 and I got it in the mail last December 21. He also gave me his/staff contact details. I have updated them that we are done with the biometrics but as of now, I haven't heard from his office yet.

But I also constantly check our case status on-line. From the time of our AOS application last November 27, our 3 AOS applications were touched on the following dates: December 9, 11, 16 and 27. USCIS also looked into our approved I-129F petition (Fiance's visa petition) on December 27 and 28 (They haven't touched it since July 2006; when I looked at my USCIS account portfolio last December 16, the last update of my I-129F was July 2006 and it was not yet even stated there that my petition was approved but I am already here and have applied for AOS...lol. On December 27, I found out that my I-129F got updated and when I opened it, it showed approved I-129F petition dated August 2006...it took them 5 months to update it on-line). The following day, December 28, they touched our I-129F again. Well, it is just nice to know that they are looking into our case. Probably validating our documents. I am praying things will run smooth.

We haven't heard from them since December 28 and USCIS and all other government offices are still on holiday today (Ford's funeral) and my daughter will turn 21 in 4 days. But I think we are ok. We had applied on time, we were interviewed on time (and it did well because our documents are ok) and we had our biometrics done on time. Now, it is the government's turn (FBI namecheck). ..praying they will expedite the name checks. We will definitely post whatever is the outcome.

I would highly advise contacting a Senator or Congressperson. Ours was instrumental in ensuring the process didn't lag when we were in the same situation with David's son. We had noted all over his son's AOS petition that he was a possible age-out in BIG RED letters, including a cover sheet...but it was our Congressman's liaison that I feel was instrumental in the smooth transition to AOS.

You can check your District Office's guidelines as well...ours stated that six months before the K-2's 21st birthday, there was a special address to write to and alert them of the situation. They asked us to include all the K-2's pertinent info, as well as the K-1's since they needed to be adjudicated together.

Best of luck to you and hope that all works out in your favor! This seems to be a loophole that shouldn't exist, but we must deal with it how we can until it is straightened out (hopefully!).

Maybe you should contact a congressman and see if they can do anything to help with speeding up the K-2 AOS application.

I made a follow-up email again to our Congressman's office yesterday...and I received today an email response from one of his staff...The staff told me that she believes my daughter is probably alright since we are finished with the interview and the biometrics. She said that as soon as they received our request last December, they sent for an inquiry of our case immediately.Their USCIS contacts are still out for the holidays and will be back next week. She assured me that they will follow-up with them next week to attempt to get more details.
