HELP!
Good day! we had already received our immigrant visa packet and passport, we saw on the Visa of my 21 years old BROTHER the annotation telling "Valid only if "Acc/FTJ Father/Mother/Spouse".

My AUNT on the United States had already book a flight for our family but there is a problem, there's only 5 tickets left on the airlines, while we are all 6 immigrant to travel. So my AUNT just decided to book a flight for my 21 years old BROTHER on another airlines. So he will be travelling alone. We have the same date of flight but were not the same time of departure and arriving on the United States. There's a little bit worry because they put on his visa the annotation ""Valid only if Acc/FTJ Father/Mother/Spouse". So does it mean that he will be required to be accompanied by our MOM?? What is the best thing to do? What should we do? My MOM cannot accompanied him at the Port of Entry (Immigration Officer) on the United States because he will arrive first ..

I entrust everything to GOD.. I believe that He will make a WAY..

Obviously the visa tells you that your brother should be accompanied by one of the people mentioned.So he cannot go to USA if he is alone, as plane as that.

or if somebody knows better, just correct me :@)

well actually he is not totally alone, its just that we just have a different airline, and the case was he will just arrive more than 5 hours before we arrive at the United States..

A few hours wait prior to going through immigration while your other family members arrive isn't going to kill him, is it?

Even if they are gonna arrive later than your bro, they are still not together!Accompanied by means Accompanied by.If they are not gonna arrive together and not on the same flight means, he has no company.Your aunt should have looked into your visas before booking flights.If he will not be accompanied by any of the said person, then he cannot use his visa.So either change flights or he is not going.

It's not CBP that will be a problem.

It's the airline.

The airline may not let him board if his visa has the restriction and he does not met it.

What's the plan if the airline don't let him board?

Change the plane ticket. That's the move that will help the most.

GOD helps those who help themselves first.

My concern was also with the airline not letting him board... If he did and arrived in the USA... He could possibly report to the immigration showing the flight that his family will arrive on so they might hold him in secondary until they arrive. However, if the airline does it let him board, then everyone is messed up... Something to think about...

Quit spreading misinformation please. Visa says "Valid only if Acc/FTJ...." where FTJ stands for Follow To Join. They don't have to be together, just all derivate beneficiaries need to enter either with of after main beneficiary.

When getting off our plane, usually the officers surrounding the plane door and the corridors to the immigration hall don't like to see people loitering around. I doubt they'll let your brother hang around for 5 hours before proceeding to immigration and I doubt immigration will let him in by himself if he is even allowed on the flight alone.

It's your choice: spend the money and change the flights, or save the money and deny your brother entry to the States.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.
