Ridiculously excited, but we need help!

Hey everyone :)

So I was sitting on the couch at home, and randomly decided to check on our k-1 case status on the USCIS website. I stumbled upon this little gem...

"On February 18, 2014, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations."

Now, to the bulk of my question...

My fiance is set to come back to visit me utilizing the VWP this Sunday. (2/23/14) We did not expect our case to move so quickly, so we figured the few months that she would be here visiting me, would be time that we could spend together while our case sat on a desk for weeks. But here we are!

We are curious what our best course of action would be. The two options are - she either comes here we had previously planned, or we cancel her flight and she remains in Australia to be able to facilitate everything that she needs to do.

In terms of what needs to be done at this point in the game, can she have her medical exams done here in the U.S. or does it have to be in Australia? Does she have to do her interview in Australia, or is there some way that she could do it in the U.S.?

​I know that there is guidance in the paper copy of the NOA2, but we've still yet to receive the actual paper copy in the mail since it was only just mailed today.

Has this happened to anyone else? ANY kind of advice/guidance would be GREATLY appreciated.

04/19/2018 - Email received from USCIS instructing me to return my GC for expedited correction - Mailed out today

She will be processed in Australia (why do you have England in you profile?) - medical exam and all required documents brought to the interview.

No, she can't come to the US and finish processing there - that would be immigration fraud - coming to the US on a tourist visa with intent to adjust status.

She can come visit within terms of VWP.

I would check the Australia sub-forums to ask about what's specifically needed for the Embassy - she will have to interview there.

Because you've been adjudicated at CSC, do bear in mind that that center tends to send petitions off to NVC somewhat slow. Some cases have taken up to tow months to be sent. That means you still have some time, assuming the same happens to you that's been happening to everyone else, before the interview is set up.

I would visit on the VWP, and pay attention to when your case is sent to the Embassy, then go back to Australia.

Also, take a look at the Yes, You Can Visit thread for tips and info on how to get through Border Control while on a K1 visa process. Good luck and congrats on getting the NOA2!

No, she can't come to the US and finish processing there - that would be immigration fraud - coming to the US on a tourist visa with intent to adjust status.

She can come visit within terms of VWP.

She's an English citizen, but she is living in Australia.

I never said anything about her coming here on a tourist visa, nor having any intent of adjusting status while she was here.. not sure where you got that from.

Just wanted to know if we can get her medical done in the U.S. We were pretty sure she'd still have to do her interview in Sydney, but it was worth asking since we weren't positive.

But to give you precise answers - no, she can't do a medical in the US and no, she can't do an interview in the US - everything will need to be done in Australia as her visa will be issued there.
