Thank you very much for the detail informtion... through pretty much heart broken with the current situation where we will need to live seperately for almost two years.

I do understand about visa waiver program that she can visit the us up to 90days, but I also heard INS can question her by visiting too long (with in 90 days) or visiting too many time (not sure if this is true or not)

So, which stage does it have to be in order her to legally live with me and wait for the legal status in the U.S? Is that the after the interview? is I-485 after the interview?

If CBP suspects that she is abusing the VWP to illegally live in the US (essentially spend more time in the US than outside the US), she can lose her VWP privileges.

She can legally come live with you when she has an immigration visa. She would need to interview to get the visa. So interview, then visa, and then legal entry to live in the US.

You will not be filing the I-485. Your wife is not adjusting. She is waiting for an an immigration visa which does not involve the I-485.

I had the impression that I had to file I-485 after I130.

So, in my caes, I only file I130 and wait for her for visa, am I correct?

No.

You would only file the I-485 if she was in the US and a visa number is available to her. Without a current PD, a visa number is not available so you can't file the I-485.

There is much more to file than only the I-130 for a visa. Read the Guides. You still have other forms to file with the I-130. You got the I-864. Your wife got the DS-260. (Do not worry about the I-864 or DS-260 since they are needed near the end of the wait for a current PD).

You are probably overwhelm right now. Take a breath. Get the I-130 in for now. After that, you can concentrate on the other forms.

i only read what you've written, note a glaring error with your idea to send an original something.

photocopies only, needed with I-130, not originals, for the marriage certificate and translation document.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I was reading the General Instruction of I-130 and got my attention on G, and I

-->> We just got married in Jan 2014, and we dont have a joint account yet. Does anyone know this can be a probem? Or do I need to ask my wife to come to

the U.S just to make the joint account?

I Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the martial relatioship.

-->> Can anyone from my family can be the third party?

-->> or Can my friend in the U.S be one of them?

1) That is for people already in the U.S. If your wife were in a legal Visa like F-1/H-1/L-1 and lets say you as an LPR are going to file I-130 for her then you need to show co-mingling of finances. Immigration knows that she cannot be added to your bank account(most banks) with out an SSN that your wife will not have since she is outside U.S.

2) Marriage Certificate with proper seal/stamp and divorce decree (if applicable) should be good enough for most cases. That is all we sent for I-130.

List of docs we sent when we submitted our I-130 :-

1) Copy of Petitioner's GC

2) Copy of Petitioner's Birth Certificate

3) Copy of Petitioner's Divorce Decree

4) Copy of Petitioner's First page of passport

5) Copy of Marriage Certificate between Petitioner and Beneficiary

6) Copy of Beneficiary's Birth Certificate

7) Copy of Beneficiary's Divorce Decree.

8) Copy of Beneficiary's first page of passport.

Most of the answers I got from this site were more helpful than three lawyers I have spoken to. One of the lawyer told me to file K-1.... #######

Mumbai embassy lets only the beneficiary in(one who has the I/L). They did not let me in.

For your wife's interview, did she get the letter in India? or did you get the interview notification to your address in the U.S?

I/L was sent by email. They don't send letters by snail mail anymore. it was sent to both my wife's and my email address. You have to give your email address to the NVC rep when you get your case number from NVC.

Wow. Thanks so much for the reply. I was worried that what happen if we dont get the letter due to the moving situation. So, our case number will be given to us when they approve I-130. Is their a form we need to fill out for the email address?

No. Once your approved I-130 heads to NVC you need to cal NVC and ask for the number. During that call you could also give them your email address.
