Hey I am new to this forum and I have a couple of questions. First off, I was living and working overseas with a foreign company for the past year. I am now back in the US and I am contemplating on whether I want to do the k1 fiancé visa to get my fiancé over here or if I want to be sneaky and try the b2 tourist visa and then patch everything up when she gets here. Any suggestions or comments about this idea?

If I do the k1 visa, I may have some problems with the financial proof. I make wages over the poverty guidelines.............. but since I was working overseas last year, my US income isn't going to amount to much. Is this going to be a problem?

Any suggestions or comments or help at all would be much appreciated.

Information includes:

I am in the United States.

She has a 4 year degree in nursing and is currently working and is currently in Thailand.

We are both 27yrs old.

We have no children.

You will need to be able to sponsor her whether you do the K-1 or the "sneaky" way.

Do not violate immigration law. Do the right thing and apply for K-1.

To try "to be sneaky and try the b2 tourist visa and then patch everything up when she gets here," could be construed as immigration fraud. You will find little support or discussion for this type of activity at this site, as that could be a violation of this site's terms of service.

Do your immigration journey the legitimate way.

Well shame on me....

Anyone have an answer to the second question? Do they look at just your current wages or if I submit my past 3 years of employment history will they take it all into consideration as a whole? We are carefully trying to put the k1 visa together. If anyone has been in this particular situation, your suggestions would be greatly appreciated.

Depends how much. You'll need to be making enough to sponsor (look up the I-864p poverty guidelines). For a household of two, it's approx. $20k income per year needed.

If you don't make enough, you'll need a joint sponsor for the I-134 and then the I-86

And yes - *current* wages matters.

16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
