Can spouse stay in US processing for NVC and visa interview?

We are currently both living outside US, however we might consider moving back to US before IR-1 processing is complete.

I (spouse) have a US visitor visa and there's no problem of staying for a few months in the states as a visitor, but not so sure if it's legally allowed to go through remaining processing (NVC and interview) from inland, any advice?

There is a chance you will be turned away, they will see your petition and ask for strong ties outside the US

You can visit during NVC processing but you can't have your IR1 interview in the US, you'll need to return home for that.

If you approved visa and cbp lets you in, then you can stay here while your case is processing at NVC.

Interviews are done at the consulates. You can stay in the US while NVC is processing your case though, if CBP allows you entry.
