Hello,

I'm a little bit confused and I don't know what I should expect in term of waiting.

I'm a green card holder, my wife is here with me in US she entered when we were still friends with a student visa.

We started to date, got married and started the I-130/I-485 journey. Nationality is italian.

- I-130 PD - 04/30/2013

- Approved petition sent to NVC on 08/08/2013 by USCIS

- 09/16/2013 notification from NVC stating "If the applicant intends to adjust status with U.S. Citizenship and Immigration Services (USCIS), contact

the NVC before taking further action or making any payments."

- Called/emailed NVC and USCIS and received confirmation from both ends to proceed with I-485

- I-485 sent to USCIS - receipt notification received on 10/31/2013

- Biometrics on 11/26/2013 at USCIS

- Interview on 02/13/2014 at USCIS here in USA

The interview went well. Just few generic questions and the I-485 checklist.

The IO said that we will have to wait until a visa is available to get the green card and he couldn't give me an ETA.

Now looking the bulletin for F2A (other countries) the cut off date is 08SEP13. Our priority date is 04/30/2013. My understanding is that a visa should be available.

Is the visa availability based on the I-130 priority date? Not the interview date, correct?

With all these retrogression concerns I don't know if receiving the green card is a matter of weeks, months or years for us.

Anyone else in a similar situation who can share the experience and shed the light?

As you say, since her priority date is current then a visa number is available for her, and her I-485 is approvable today.

If the IO knows what he is doing, hopefully.

If you've heard nothing within 60 days you should make an Infopass appointment and enquire further.

Depends on what did IO exactly say. Did he say that he cannot approve because there are no VISA's available or did he say if there was anything else pending on your case?

I would not wait 60 days. Who knows what VB might be in the coming 2 months. If i were you, i would wait 2 weeks and get an infopass. If all the paperwork is OK with your case and if approval is the only thing pending i don't see why it would take them more than 2 weeks to approve.

If you don't get proper answers at Info pass contact your congressman/woman and ask them to check on your case.

I was told by my lawyer that 60 days is the earliest you can usually enquire after a green card interview.

For sure the paperwork was ok and there are no pending items on my side.

He just referred to the visa availability to receive the green card.

Yes, the VB is what really concern me. With the retrogression rumors who knows what will happen.

My doubt now is who has to move the next step? NVC or USCIS? I can call them referring to the PD and current cutoff dates, but I'm not sure who I should talk to.

Can you please explain the infopass? Not sure what it is. Maybe there is another post you can direct me to.

Infopass is basically getting an appointment at the local USCIS office and checking on your case. Here is the link to schedule one. https://infopass.uscis.gov/

If there is nothing pending and you are preadjudicated then i wouldn't wait for a long time. Since yours is AOS (Adjustment of Status), NVC does not even come in to the picture. Its all USCIS. If you try calling USCIS they will ask you to wait at least 30 days and you will not get much help. Try Infopass which is a Face to Face interaction with IO at local USCIS office.

The case status changed yesterday.

Current status is:

Card/ Document Production

On February 19, 2014, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.

This step applies to applications that result in an applicant receiving a card (such as a "green card") or other document (such as a naturalization certificate, employment authorization document, travel document, or advance parole). Applications will be in this step from the time the order to produce the card/document is given until the card/document is produced and mailed to the applicant. You can expect to receive your card/document within 30 days of the approval of your application.

I believe the visa check phase is passed and we will receive the green card in 3-4 weeks. Am I correct?
