Hi All,

I'm new here. Here is a short story. My fiancé is in Taiwan and everything is approved for her to enter on the fiancé visa, interviews are done etc..

Well the wedding was to take place in Taiwan (then legal one in the states) in a month until I postponed it. Without getting too deep into it, we've been engaged for 2 years and haven't seen each other much in that time. I was freaking out because I feel as though we've lost something in the relationship. I now want her to come here for a few months so we can reconnect then marry if we still feel that it is the right choice. Then we would like to go back to Taiwan so she can do a proper wedding for her people. Now I'm finding out that it is difficult to leave and re-enter the states. Is it a huge process to get Advanced Parole? Things are such a mess right now. This whole process has put such a strain on the relationship.

Advance Parole is routinely approved for people with AOS pending. Though I don't understand from your post if you plan to marry or not.

You can't get AP from a K-1 visa. You must marry and file for AOS.

At this Point, If I go to Taiwan there will have to be a ceremony. I postponed the ceremony. The pressure on me will be intense. I can't afford $$ or time off from work for multiple trips which is why I would like her to come here first since we have 90 days and her job will give her the option of returning if things don't work out.


Taiwan doesn't require a visa to come into the united states as a visitor. Why don't u just pay for her to come as a tourist, decide, then have her go back to Taiwan and wait for the K1 to be approved.

Too Late. The K-1 is approved and finished. she has one shot to enter the U.S. if she doesn't marry, the visa is null. She wasn't allowed to visit during the application process.

What I will suggest is not in the spirit of the visa, but perfectly legal.

She can come and you can use the 90 days to see how things are. If things are good, you can marry and file for AOS, and when she gets her AP you can go have a wedding ceremony in Taiwan.

If things are not good, you do not have to marry and she can (read, must) go home.

if you are not sure, she can go home and you can later file for another K-1 or marry and file for a spousal visa.

Is the AP pretty straight forward? we won't need a lawyer or anything like that? do you know approx. how long it takes for the AP to be approved?

One other question: Do you Know if her deadline to enter the U.S. on the K-1 visa can be pushed back? I think she has to be here by the end of march.

AP is routinely approved for people with I-485 pending. You just need to apply for it (and be in an eligible situation) to be approved.

It goes with a big AOS package, which costs $1070. The AP part of it is free, but must be connected to a paid I-485.

She can contact the embassy about extending or reissuing the visa, but I think not. It has to do with the validity of the medical (not good forever).

Ap usually takes within70- 90 days to be approved... So after you marry and file for AOS and AP, she should have AP approval 90 days after.

4/4/2013. : Oath! Now a U.S. citizen!
