That damn Affidavit of Support!

Can anyone tell me for sure, once and for all, if a K1 applicant must bring the I-134 or the I-864 form to their interview in Montreal?

In december, I was told by the consulate that "The Form I -134 is usually used for fiancé visa applicants, not the I-864. The petitioner can file an I-134.".

In February, I asked another question and I was redirected to the newly updated Packet 4 PDF which states "OBTAIN THE ORIGINAL I‐864 AFFIDAVIT OF SUPPORT AND COPY OF THE RECENT U.S. TAX RETURNS This form is legally required for: Applicants for family-based immigrant visas, including certain orphans. Applicants for employment-based immigrant visas where a relative filed the immigrant visa petition or has a 5 percent or greater ownership interest in the business that filed the petition.the petition. I‐864 Instructions: HTTP://TRAVEL.STATE.GOV/VISA/IMMIGRANTS/INFO/INFO_3197.HTML" The same Packet 4 instructions does not mention the I-134 as another option for some clientele such as the fiancé visa applicants.

Now, is a K1 visa considered a family-based immigrant visa? Because from what I understand, that would determine whether I DO need to bring the I-864...

I did read a lot of older threads about this, and everyone seems to point out that the I-864 is only for the Adjustment of Status petition... but I want to know for sure since I seem to change my mind everyday about what I understand about all of this...

Thanks so much,

Marie-Eve

You will need the I-134 for K-1 interview.

You will need the I-864 when you Adjust Status for your green card after you get to the US and get married.

Thank you both for this confirmation!
