My Wife now, and I were denied a Fiance visa, so after weighing options, I went to China and we were married. Now I find myself in a state of hi anxiety, When I applied for the Fiance visa, I sent USCIS all original copies of proof of everything, I am aware now that I should have sent copies. Now I find that for proof of marriage, we need joint accounts, and a history of a life together. How is this possible when we have not lived together, she is still in China, and I don't think it's possible to open accounts without a social security number.

to the OP you file a G-884 form to get your originals back from USCIS. You can go here to the USCIS to download the form http://www.uscis.gov/sites/default/files/files/form/g-884instr.pdf

Good luck, it will take a few weeks to get them back

Many couples are in the same situation as you are.........you can show proof of sending her money for support and get affidavits from people that went to the wedding and viewed you living as husband and wife for the length of time you where there...........you probably wont be able to get her onto your bank account until she is in the USA unless they have the same bank in her country and that's not even a guarantee .........i have no clue what to say about the originals you no longer have

Although there are 6 types of evidence listed in the I-130,

remember that the I-130 is a multi-purpose form,

and

USCIS and the IV Unit will know that 'recently married and living apart' won't have that much evidence, primary evidence, to submit.

However, SECONDARY EVIDENCE is great.

Here's what I was able to do, 30 days after hitting USA soil after getting married in Wuhan:

I think you'll have to add more as you filed an I-129F chasing a K-1 earlier, you'll need to address (via letters of attestation) the reasons behind the denial in a rebuttal-ish fashion.

Thats about the same that we did only difference is he is the one sending me support money by way of money transfer to my account.........

I have the same issue when I first started it and I was approved for the I-130. A jointed account is one of the things you can show but not THE thing you need to provide. Subsequently, I managed to get her on my HSBC account, but that was a major pain in the ####### from the bank whom I have to threaten with a legal review of their policy and reach a compromise. Getting the ITIN is another major PITA too. With all that experience, I really appreciated how inefficient the fed and the whole process are.

Some quick fixes: put her on your cable bill, trash bill, magazine, newspaper subscriptions. Apply for gym, discount store membership jointly, etc.

Now I find that for proof of marriage, we need joint accounts, and a history of a life together.

USCIS does not require nor do they expect a couple living apart in separate countries to have joint accounts.

April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)

Agreed your G-884 info is of great help to the OP. He would have got the same info when he contacts USCIS and thats what i advised him.

yes I will elaborate, merely calling the USCIS won't get his originals back, so your point is way off base. He has to file that form, that is the only way to get them returned.

We don't have joint anything either. We just sent in chat logs, photos, screenshots, my boarding passes and credit card bills. But then again I got pregnant before we got married so that was our main anchor. I think we were only married for 2 weeks before I had to fly back home.

We're exactly at the same place as you are, except our case seems to be taking forever. I just sent our request for evidence packet today. I had called their offices to ask about what I can provide because everything on that list was impossible since I live in the US and my husband has been living in France this whole time. We've been married a little over a year now and it feels like our case is moving really slow. Anyway, for the 2012 and 2013 year we filed taxes jointly in the U.S. She said it was great to submit that (mostly anything with both our names on it-better if legal documents). So I put our tax papers, insurance policies where we are each others beneficiaries in our life insurances, (never had the chance to create join bank accounts) but he has bought flight tickets for me so we submitted that-where they say my name as the passenger and he's the one paying so he even added some bank account activity, we put pictures from before and after our wedding, added cards we've exchanged for special occasions, mail we've received at an address, facebook posts/interactions, notarized letters from close friends and coworkers who have seen us many times and can testify we're in an active marriage/relationship. We also wrote letters explaining why we're asking for him to come to the US and why I am not moving to France. The immigration agent said to make it stand out and she said letters from people were great for that.

I hope this helps and like I said, I'm on the same boat. We're hoping to hear soon. We don't know what much else we can provide but the fact that we've been dating long distance since June 2011 and have been married over a year has to mean something (We know they need to be sure that something is not fake or suspicious but it just sucks when all we want is to be together). So you are saying that if someone calls USCIS, they will not advise someone to file the correct form to get the job done ?

Calling an agency is the first thing one would do to start things moving. i pointed him to the right direction. of course you gave him more information which is good.

But just replying to people saying wrong is not the right thing to do. I was not wrong at all.

About the joint accounts, I created a joint account with my husband without an ITIN number, without the bank also being in his country. You just have to call your bank and ask, it's generally paperwork and proof of identity. I don't see why a spouse being in a foreign country needs to be a deterrent.

Proof can include chat, email, phone records, text records, skype logs. Think outside of the box. You don't have show that you've had a life together, but pictures of trips together, the wedding, letters of support from family, etc.
