Hi, I just wanted to get the community's opinion on what my chances are that I need a co sponsor for an I-864. I have not been asked for the affidavit of support yet but I would like to be prepared with a co sponsor ready as a backup if necessary. I know that it requires a few years of tax returns which I don't have. I am only 23 years old at the moment and I just started generating income in the year 2013. Previous years were just work I did here and there as a student so my income was very low.

2011 Gross income: $3,000.00

2012 Gross income: $6,000.00

2013 Gross income: $110,000.00 Net Income: 50,000

I only started making money this year and I was wondering if this will affect my I-864 since my previous years had very low income. Do assets come into consideration? I don't own any real estate but I have a car thats under my name and about $200,000 cash in the bank.

If my I-864 gets rejected then will I have to get a co sponsor and resubmit a I-864? Will it be better to just have a co sponsor the first time I submit the I-864? If the I-864 gets rejected will the case be considered finished and I will have to do the process all over again?

They mostly care about current income. If it comes up explain that you were a student previously, but have solid proof to show that you're now making what you are.

December 12th, 2013: Picked up marriage license.

IMO - 0.

Why? Guangzhou IV recently switched to :

1. last years tax data and

2. current annual income

200K in assets trumps all.

Darnell. that is VERY misleading. Also potentially CORRECT, but still misleading at the same time

Other factors include the applicant's health, education, family status, age, language ability, and work experience.

Again, it is mandated by law that consular officers consider the totality of circumstances, and not just rely only on whether income surpasses the poverty guidelines.

So, it is quite possible that some applicants have been found to have a public charge ineligibility in spite of having a petitioner or co-sponsor with income greater than the poverty guidelines.

Having enough money in the bank to be able to buy a Lamborghini paints one picture. A steady job or the ability and resources to be able to land a steady job or source of income paints another picture.

The determination of whether a visa application may become a public charge in the U.S. is ENTIRELY at the discretion of the visa officer.

Any recent individual cases of even longer term "trends" that may have been spotted don't change the law - "that consular officers consider the totality of circumstances"

I don't mean to alarm the original poster, whose circumstances MAY BE entirely adequate to guarantee that she won't become a public charge.

I would recommend that you establish the SOURCE of your income AND the continuing nature of that income.
