Some people seem to think what matters is what they feel is right, not what the rules or laws of a country are. They're also the ones that come crying when they find themselves in a trouble because how they felt things should work, is not how they actually worked.

We are going through this in Ukraine, right now. She will have to go to court, and obtain a decree of sole custody. We were told that the courts there do not like to do this, but under the right circumstances, it can be done.

My stepson's father left Ukraine, and went back to his home country several years ago. He has no contact with his child, or my wife since, nor has he given them any support. She divorced shortly there after, and was given permission to take the child out of the country. But the US State Department will not issue the child a visa, unless the mother has sole custody. The travel document isn't good enough.

Those are the grounds our attorney filed the suit with.

Plan on a year or so to get through the legal process, and it might cost several thousand dollars.

Try and have her locate an attorney that knows their way around Ukrainian family law in her city, and start there.

Unfortunately, you will have to clear this issue up... Otherwise you could find yourself in a big situation down the road... As others have said, you need to consult a lawyer versed in Ulraine custody issues. Hopefully, given he is in prison and never had contact with the child they will be able to persuade the courts to grant sole custody... Us immigration will not ignore the International jurisdiction of Ukraine when it comes to its citizens, so this needs to be taken care of in Ukraine.
