Files I-130 3 months ago, should we file for K-3??

Filed I-130 November 1 and received NOA1 November 13, 2013

We do have an immigration attorney assisting us. He was referred in and appears quite knowledgeable. He has many cases in process and we spoke with a number of references (some folks we know personally) that were approved. However, at the time we filed the I-130 the attorney recommended skipping the K-3. He said it would take about the same amount of tme and would likely be a waste of money and time down the line.

Fast forward 3 months. Based on what I see on the processing time charts here (and USCIS chart) it appears processing tmes for the I-130 have skyrocketed the last half of the year. Now I'm regretting not fiing for the K-3 so Roslait could be with me sooner (maybe) while we await the I-130 CR-1 process.

What advise do the folks here have? Being already three months into the I-130 CR-1 process the value of the K-3 is diminished greatly I would suspect. On the other hand the K-3 charts are saying 5 months for the approval to the NVC and we might have another 7 months to go waiting for the NOA2 for the I-130 CR-1.

I'm really disappointed we missed this opportunity to possbily be together quicker before finding this site and learning more about our options. Any advice is appreciated.

There is honestly, in my opinion, zero advantage to filing the 129F for the K3 and that will not get your wife to the US sooner. In fact, the chances that the I129F will be closed is high.

October 16, 2015 - US Citizen

Timeline

From the evidence of other recent cases USCIS will probably just marry up the K3 to the ongoing I-130 and it won't save you any time. There are filers from last spring/summer who filed a CR1 and K3 petition and both are still waiting to be processed.

Thank you for your quick replies. Waiting is indeed difficult but creating false would be worse. We are hanging tough and are using our time to gather and refine all of our data for the next steps. We are also blessed that I have the opportunity to visit Rosalit at least once a month. I know some others have it much harder.

Thanks again and any other thoughts or oinions are welcome. I'm so grateful we found this place. Knowing your not alone helps too.
