My wife and I are currently in the AOS process from her B-2 visa to a green card. The inital paperwork was updated to Initial Review on Oct. 21, but a request for inital evidence was sent (the only evidence requested was a tax transcript for form I-485). The USCIS received the additional evidence on Dec. 09. Her online I-485 status has not changed from Request for Envidence Review since Dec. 09. Her I-130, I-131, and I-765 statuses have not changed from Initial Review on Oct. 21. When looking at the VJ timelines, should we be estimating the processing time from the Oct. 21 original filing date, or the Dec. 09 RFE submission date? Is it normal for the statuses to have remained unchanged for this length of time? Thank you very much for any assistace.

You start the date from when you first receive your NOA1 (October 21st) and if you have an RFE, the timeframe for all applications is paused until you submit it and it gets process by the USCIS. It doesn't restart the 30-90 days for the EAD/AP.

Also, from many and many threads I've read, the online system is very unreliable and rarely updates properly, so I wouldn't be rely on that. You can always call or if necessary, schedule an infopass since even with the RFE, it's been a few months since you filed and a while since you've received any sort of paper-update or text/email update on your case I assume?

Regarding the RFE, per the USCIS article I have provided the link to, when the RFE is for initial evidence, the clock stops and STARTS OVER after the receipt of the RFE response. If the RFE is for additional evidence, it stops but continues from it's last stop point upon receipt of the RFE. So initial evidence makes the process start all over again while additional evidence makes it continue from where it last stopped.

We received an RFE for initial evidence for something we orignally submitted, but resubmitted with RFE. After about one month in RFE review, our I-485 status changed to Testing and Interview and my wife's EAD was approved and shipped.
