Timeline

K1 wife and K2 son (9 years old) have been here since July. Thought we were done for a while since they both received their EAD's and my wife received her Greencard two weeks ago, but last week I got an RFE for the the K2 son. The notice came from my local USCIS Field Office (Columbus, OH), and on the RFE, they acknowledge that they received the sealed I-693 that we had transcribed from a Civil Surgeon. The USCIS is telling me that they do not have the medical examination that was submitted in connection with our prior K-2 nonimmigrant visa application for my K-2 son. We did the entire process for my wife and her son at the same time (medical at St Luke's too). Seems my K-1 wife's medical examination from the nonimmigrant visa application is not an issue, yet they do not have any record of the medical examination in connection with my K-2 son.

I don't understand why the AOS for the K-1 was no problem, yet the AOS for the K-2 son has hit a stumble.

Since you said you sent it in and they told you they do not have it on record, it means they probably lost it. So per their RFE, send it back in. When dealing with USCIS, it is important to go by the book. They are humans and make mistakes too, so when they request for something, regardless of whether you have previously sent it in just send it again.

Help them find the error in their ways. Besides, if you don't, it may cause issues for you down the road. Recall it is their playing field, and their rules.....

Give them what they want. It's hard to argue with them. I suggest getting a new medical for son. This should fix everything up.

They lost the medical exam he had for the K-2 visa. Did he get another medical from the civil surgeon, or just had the vaccinations transcribed onto the I-693?

Hi Jay-Kay. We only had the immunizations transcribed onto the I-693. K1 wife and K2 son had medical examinations in the Philippines as a part of the Visa process. None of us ever received a copy of the medical examinations. So, I guess these medical documents were sent directly to the US Embassy in the Phils, then enclosed inside the envelope that she was not allowed to open that was taken from her at her POE? Why did USCIS grant my wife a greencard, yet they RFE'd her son for medical documents? So I need to take my son to a doctor get another copy of a document that I have never been allowed to possess?

Do I have to take him to a Civil Surgeon for this medical exam?

I do appreciate all replies and opinions.

Yes, the medical documents are in the sealed envelope you turn in at your POE. Sometimes the medical forms seem to get separated from the file somehow, and then they send an RFE for missing medical documents. They lose them, and then you get penalized for it. You will have to get another medical from a civil surgeon and send them another I-693.
