That's kinda my point. I doubt the guy that leaves his pool gate open is going to go to jail if someone drowns.

'I doubt'. It happens. you can be held criminally negligent if death occurs and imprisoned if the circumstances warrant it. Sometimes they do. The person in the article plead guilty. Not sure how else to say it, it's not really got much to do with the fact that the death was as a result of a firearm, but the fact that the Owner of the gun was found criminally negligent for allowing the firearm to be used in a death.

Ban all pools

Yes, that's what is being asked for, for firearms to be banned. Well done. Good show.

Nothing in this thread mentions banning guns. it's a thread that shows what can happen if you are negligent when you have a gun in your home; you can be criminally liable for any accident that arises that leads to a death or injury. Either you think that's a good thing (I do) or you think it's a bad thing or you have no opinion. Opining that thinking that you should be held liable for said accidents is analogous with pool ownership and should lead to a demand for pools to be banned is what makes no sense so carry on not replying, that will be all around a good thing.

Why was this guy's wife not charged as well? Wasn't it her home too?

Good point. She should be tried as an adult as well. She was a knowing accomplice.

Guy shouldn't have been charged with anything.

In California, its criminal storage if someone is hurt or killed by a minor if the firearm doesn't meet certain criteria - i.e. locked up, trigger lock, unloaded stored separately etc.

Last year I believe this law was expanded to include felons as well.

Yeah handguns are required to be registered in CA and the person listed in the CA DOJ database is responsible.

Guess that makes sense. It would be hard to pin the blame on a multi-family home full of adults. If I move to CA, I will either keep all my guns unregistered, or have my wife buy all the new ones. Thanks for the tip!
