Hello everyone,

Recently brought to my attention that a USC needs to file and pay taxes if they live outside the US. Ignorance I know is no excuse but I didn't know this. I haven't worked so technically nothing to declare as income. Being supported by my non-USC spouse. What can I do now? Esp since I need tax returns for filing I 130. Thank you

You do not need to file tax return if you had no income. The same happened to my husband, the USC, who came to live with me in Ireland for several years. he submitted the following statement in lieu of tax returns:

To whom it may concern,

I am Penguin_ie's husband and petitioning sponsor. During my three years in Ireland I did not work; I used savings and was maintained by my wife on her salary. Thus, I had no income or significant holdings in the USA was not required to file US tax returns with the Internal Revenue Services.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I don't recall sending tax returns for those two I-130 forms for my wife and her daughter. But did have to send in an certified financial statement to prove I had enough cash to support them and pay extravagant USCIS fees or something like this. Was for that I-864.

In my own strange of thinking, just gathered they don't want us poor folks here bringing those poor here, at least legally. Had to prove I could support both of them at least 25% above the so-called minimum poverty wage.

Now when it came to the ROC and citizenship stages, this is when they wanted to see our tax returns.
