So here is my situation..

Me and my wife got married January 2013. I just filed my taxes as single which technically not the right thing to do. so i'm trying to amend it and file as Married filing Seperately. Our case right now is that we are just waiting for the case number from NVC. Here are my questions:

- During the interview, what's the probability of the consulate officer questioning the status in the Tax transcripts? (I've been researching about denial of visas and could barely find a case about being denied coz of the tax status issue)

- So my plan is just to submit my 2012 tax transcript , my w2 for the last 3 years including 2013, some pay stubs AND my 2013 where is filed as single. Let's say my case progresses and my Wife will be for interview. Can I just send my wife a proof that I was amending my 2013 tax from Single to Married filing Separately? and a follow-up what is that document that I could send her that could prove that i'm trying to amend my 2013 taxes.

- if I could get some help and feed backs about my situation.. I would greatly appreciate it. thank you! =)

Im not an expert but I don't think filing as single is going to be an issue as long as you can show that you filed taxes you should be fine. If they do ask just say the truth why you filed as single. Its very unlikely they will ask about it tho.

hey man im on the exact same boat as you, i filled single bc sincerily it didnt let me do it married in anyway. so i am waiting for my wifes nvc number and im going to go ahead and amend the taxes while the whole nvc process is going on so that by the time of the interview they will be amended and no issues IF THERE ARE ANY which i dont think bc i filled taxes and obviously my wife is not here for me to claim her..

hey man. right now still waiting for a case number. they received my papers on feb 6 and they said it takes 20-30 days for them to process a case number. just make sure your w2 and your paychecks says your married though. thanks man. you too. good luck!

hey man, so i have been doing alot of research and called a couple of lawyers and tax accountants.

so my lawyer said to find out if i was doing anything iligal by filing single. she doesnt think it will be an issue.

i called an accountant and he said that i was doing the right thing, if i tryed to file as married then i would need ssn from my wife; so he said that he can put in a certified letter from him stating my possibilities i had and why those didnt work and that also he will specify that once my wife is here in the states and i have a ssn then we will go ahead and amend the taxes as married filing jointly.

let me know if you hear of anybody saying AMEND ok men, bc im like you i dont want my wife to have any issues right at the end of all of this.
