Hello everyone,

just recently a friend who has a temporary green card with removal of conditions in july 2015, has taken the courage to tell me she and her kids are in an abusive relationship. I know she has to file a separate I751 and not jointly with her husband, but what's more important what are the steps she needs to take to keep herself and more importantly the kids safe and also start building proofs for her case to be approved by uscis. Is it by restraining order? She is afraid to leave the home or the kids and can't go back to her country. She wants to stay here in the US.

Any help is appreciated.

Thank you

Your friend can report the domestic abuse to the police which will result in a domestic violence charge against her husband. When the case is filed in court an automatic mandatory protection order is generated against the abusive husband which directs him to surrender any firearms he owns and/or refrain contact from the victim.

In as far as removing conditions, provided she is able to show proof of marriage in good faith regardless of the outcome of their relationship (i.e. separation or divorce) then she can file for removal of conditions/I751 o n her own. Sein oder Nichtsein, das ist heir die Frage.

She should contact a domestic violence women's shelter. They have the help she needs. I would not contact the police until she has a support system in place, because of the abuse, some women take back what they said and then get killed by their spouses in their next attack. Be careful.
