First, thank you all for your help.


I entered the US in 2008 on an F-1 visa. In 2009 I started dating an American citizen. We got engaged in December 2011. We both visited my home country (and she met my family) in January 2013 and I re-entered the US on my F-1 visa in February 2013. We got married in June 2013 and in October 2013 we applied for AOS. We had also applied for AP so we went back home in January 2014 and I re-entered the US using the AP (without any issues) a few days ago. During this entire time I have maintained F-1 status, and I am still at the same institution (I am in a PhD program). Obviously, I am not in F-1 status now, since I entered the US using AP.

My questions are:

1) Did I unwittingly commit visa fraud at any time?

2) We didn't apply for EAD since I am in graduate school. It didn't cross my mind that graduate school could be considered employment BUT I have a scholarship. Can I still go to school now that I have entered the US using AP?

doesn't sound like it...you asked for AP, apparently got it, used it, returned and went back to school....that's how it's supposed to work...there are prescribed paths or methods to follow under the circumstances you described, and you followed them....a round of applause, please, everyone.....for somebody who did things above board....this is refreshing to read.

1) No.

2) You can, you just don't have to since you aren't F-1 anymore (as you said, you entered on AP so your F-1 is gone).

Day 400 (2/7/19) Denial revoked; N-400 approved; oath ceremony set for 2/14/19

Day 407 (2/14/19) Oath ceremony in Dallas, TX
