Moving Family From UK to USA

Hello,

Hopefully someone can help.

I am a USA citizen and my Wife is a British Citizen. We have 2 children that were born in the UK ages 5 and 2. We have not filed for their USA citizenship yet.

My work is going through a redundancy and we were planning on moving to the USA in about a year or so. With the redundancy it has brought forward the process and I could use some guidance on the best filing practice. I will probably be out of a job, and income, by the end of April. I do have another job lined up in the USA however.

1. What do I need to file so our Children have USA passports? A CRBA and apply for their passport?

2. File I-130 for Wife?

3. Should I apply for K3 Visa?

4. Can I expedite paperwork based on financial reason? (Losing job?)

5. Do I still DCF since I am planning on moving to the USA ASAP after losing job (April)?

6. Are there any other options available for my Wife to grant her temporary entry into the USA while we are waiting for the I-130 approval? The problem is finances while she is living in the UK.

1) Yes.

2) Yes - DCF.

3) No.

4) If you file DCF you wouldn't need an expedite, since DCF is extremely fast.

5) Yes, just make sure you can prove that the US will be your domicile again very shortly.

6) She could enter on the VWP but would need to depart at the end of her authorized stay.

You should expect to have the visa in your hands within ~3 - 5 months from submitting the I-130 to the US embassy in London, if you file DCF.

Would they reject entry on VWP if the I-130 is in process? Would they deem the entry an intention to stay? I assume that she would have to fly back to UK, pick up her visa, then fly back into the USA on the visa if she was allowed in under the VWP?

Am I reading this right? This graph says it's approx 166 days for IR1/CR1 to process through London after the interview has been completed?

Those statistics are for petitions filed stateside that go through service centers. If you file via DCF, those stats are irrelevant.

This is a better graph for DCF London. It is a K1 graph, but since DCF and K1s in London go through similar steps and wait times once the case reaches the Immigrant Visa Unit, it will be valid for you also. . The only issue I see with your entire case is sponsorship. Lost at sea did DCF so please join the DCF forum and follow their advice. Your process will be very fast. I suggest getting the kids CRBA and US passports asap!!

Sponsorship will not be an issue thankfully :) It will just be a case of getting some paperwork from the USA.
