Medical Insurance for newly arrived fianceé

Hello everyone,

I was wondering when my fianceé arrives to the US, will she be able to immediately be put under my insurance that I have through work or will she have to wait till after AOS? What rights will she have when she gets here before having her green card?

Marriage is usually a qualifying life event that will permit you to add her to your existing health insurance.

Yes you can but she will have to get a SSN first so you can add her :)

K1 approved 06/13/2013

It will come down to your existing insurer and what they will allow.

I was added to my husbands right after our wedding, as we had to submit a copy of our marriage certificate to have me added.

I would suggest calling your insurer, explaining the details and asking whether they will allow her to be added before the wedding, and what proof they might need in order to do it.

I'm not sure what rights she will have that you are referring to, or if you mean as a general question.

As far as I know, you are classed as a legal alien until you do your AOS, and once you get your green card you are a conditional permenant resident.

  1. AOS has nothing to do with medical insurance.
  2. Get her an SSN immediately when she arrives. Print out her I-94 and go to the SSA office. You don't need to wait.
  3. Once you have her SSN, ask the HR department at your job. The correct response is "it depends on your insurance and state laws". Don't listen to people like Hypnos. That information was incorrect in my case.

Luckily, I got my fianceé on medical insurance while she was in the US on her K-1 BEFORE marriage and BEFORE AOS. And she had a medical issue in that time period.

- A change in family status:
- marriage
- birth or adoption of a child
- acquisition of a foster child
- legal separation
- divorce
- death of a spouse or dependent"
Generally, if the size of your family changes (most often through marriage, divorce, or the birth of a child) then this constitutes a qualifying life event (QLE). That's only one source, however it correlates with other health insurance I and my wife have held in the past.

Hmm, interesting. Never heard of the "Office of Personnel Management". Must be for Federal Government employees?

You answered the question with a condition that is sufficient but not necessary for a couple to receive medical insurance together. For example, in California domestic partners can be treated as spouses for medical insurance purposes.

Well, I'm not an expert in all of the states' laws with respect to health insurance. I do know that it logically wouldn't be wise to dismiss the most populated state's laws as a special case.
