Green Card Pending....Can I File FAFSA???

Hello!

My USC mother filed to adjust my status in july of 2013...my i485 is still pending, however.

I am trying to figure out if I qualify for FAFSA for college or not. I do have an advance parole document valid for a year but have not used it.

their website states:

I am a non-U.S. citizen. Can I get federal student aid?

If you fall in one of the categories below, you are considered an “eligible noncitizen.”

1. You are a

  • U.S. national (includes natives of American Samoa or Swains Island) or
  • U.S. permanent resident with a Form I-551, I-151, or I-551C (Permanent Resident Card, Resident Alien Card, or Alien Registration Receipt Card), also known as a green card.

2. You have an Arrival-Departure Record (I-94) from U.S. Citizen and Immigration Services (USCIS) showing

  • “Refugee,”
  • “Asylum Granted,”
  • “Cuban-Haitian Entrant (Status Pending),”
  • “Conditional Entrant” (valid only if issued before April 1, 1980), or
  • “Parolee” (you must be paroled for at least one year, and you must be able to provide evidence from the USCIS that you are not in the United States for a temporary purpose and that you intend to become a U.S. citizen or permanent resident).

As I said, I have advance parole document but I do not have an i94 in my possession.

What do I do??? I get mixed messages from attorneys, schools and people...please if anyone has had this experience I would be deeply grateful if you could explain me how this works.

It doesn't appear as if an adjustment applicant is an eligible non-citizen under the FAFSA; you would need to obtain your green card first.

Day 400 (2/7/19) Denial revoked; N-400 approved; oath ceremony set for 2/14/19

Day 407 (2/14/19) Oath ceremony in Dallas, TX
