Hello VJers,

Can you please advise me on the next step to take? I filed N400 based on 5 years since my wife and I divorced in 2011. I successfully removed conditions with a divorce waiver in May 2012.

I filed N400 April 2013

Completed biometrics May 2013

Interviewed Sept 2013

The interviewer told me I passed the civic test but a decision cannot be made.

I have called and spoke to a tier 2 twice which I was told that my case is still pending adjudication.

I had an infopass on Monday Feb 10 and was also told that my case is still pending and the officer has not made a decision yet.

Please tell me what my next move should be.

I am not sure if I should contact my congressman, senator, ombudsman or file a writ of mandamus.

Hello,

I cannot give you much advise, since I don't know either. But, it seems to me your case is out of processing time (120 days from Interview), and you need to take actions. Hopefully somebody else can give more input.

This situation really sucks. I would sue the USCIS if I was you which would for sure make force them to make a decision. I remember you talked about taking the court documents for your dropped charges to the interview. I had 2 arrests and was recommended for approval on the spot. Waste no more time and sue them. Spending $500 to sue them is not really a money wasted but an investment.

I Have almost the same issue , I applied at the end of July 2014 did my finger print on 09/2014 after that I didn't get any interview letter after made 2 e-request the answer was pending for security check , after that I contacted my congressman the answer was pending for security check,

After that I made the third e-request and the answer was pending adjudication any advice please..

I Have almost the same issue , I applied at the end of July 2014 did my finger print on 09/2014 after that I didn't get any interview letter after made 2 e-request the answer was pending for security check , after that I contacted my congressman the answer was pending for security check,

Try an Infopass, contact your congressman again and contact both your senators. If nothing works, hire a lawyer and prepare to sue USCIS. Google "writ of mandamus". You can ask a judge to force a decision on your case. That decision may be positive or negative. That last step is pretty expensive so I would wait as long as possible before taking it. Perhaps when it's been a full year since your biometrics. Just a thought. You can also keep scheduling Infopasses until you get an answer.

Those are your options.

This is an old thread and the OP was approved and became a citizen in January 2015 after contacting his congressman twice over a 4 month period. Read through the April 2013 filers thread for details.
