Hello:

My wife received her approved I-765 APPLICATION FOR EMPLOYMENT AUTHORIZATION EAD card in the mail yesterday! It feels great. It indicates she does not have conditions but says it is valid for one year.

We are still waiting for our I-485 interview to proceed.

On the USCIS website, our online status for Form I131, APPLICATION FOR USCIS TRAVEL DOCUMENT indicates on January 28, 2014, they mailed us a notice that we have approved this I131 APPLICATION FOR USCIS TRAVEL DOCUMENT. We still have not received this notice. Do they send you an actual card?

Given we are married, have a marriage license, her social security card and now EAD card, can we travel anywhere for our honeymoon and a return trip back to see her family in July? I am probably paranoid but do not want to jeopardize anything with our case.

Her new EAD card has my last name on it but her passport has her maiden name. The license and social security card also has her new last name. What do I book the plane tickets with her maiden name or my last name? We would like to finally plan our honeymoon, etc. Thank you very much for your time and help!

Brian

Wait... You have the EAD card or you don't have the EAD card? You should have a physical card with your wife's photo on it (I think it has a photo at least) and if it is a combo card for AP it will say so on the bottom of the card, does it say it is authorized for travel or some such? If so then you are good to go.

Your tickets should be booked in the name that is in the passport and you should take a copy of your marriage certificate in case CBP ask she you are trying to get back in, note: it is routine for your wife to be taken for secondary processing at the POE as they need to look up further details in a different system when traveling with Advance Parole.

Please check with your airlines before travelling as there have been a few untrained airline employees that would not allow the foreign spouse to travel with the new combo card as they have not seen it before--it has been in use for about 3 years, but I am sure it is rare to see one. Frontier and Delta both have had issues. It is the airlines that hold your fate more so than the CBP as the CBP knows what the AP looks like and how it is to be used.

If you have the EAD card, it should state near the bottom that is serve as form I-512 advance parole.

Good luck,

Dave

Thank you both! Yes, she did receive an actual EAD card with her photo yesterday. Ok, gotcha it is a combo card. I did not know if we needed anything else to travel overseas and we will book the tickets with her maiden name in the passport and provide the various information as requested. Thank you again.

EAD card for travel? No, no no.

An EAD card does not allow you to travel. It allows you to work.

Now, a combo EAD/AP card? With "Serves as 512-L Advance Parole" on the bottom? That allows you to travel.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
