Yay! More guns! Hopefully the govt. will issue every kindergartner a firearm on their first day of school.

Better yet, the gov't needs to stay out of it, as the 2nd amendment requires.

Fellow Golden Staters, don't rush for your CC permit just yet. It's almost certain that the county will call for review of the decision, in which case the entire 9th Circuit Court will hear it en banc, instead of just the 3 judge panel in this decision. In its 11-member entirety, the 9th Circuit leans more liberal than the panel (2 conservative, 1 liberal) in this decision. Furthermore, I understand that the decision was limited to the San Diego Sheriff's policy, and was specifically not extended to ruling on the constitutionality of any California law (though I base this on someone else's reading of the decision, not my own). It will be interesting to see how this develops, because the split in Circuit decisions on this matter seems to be forcing the issue to the Supreme Court.

I hope so.

And I hope the entire 9th circuit upholds the current law so that we can appeal it to the SCOTUS. Dammit, the 7th circuit didn't do it. Winning these lower level court cases is not the intent.

The problem with this ruling is that the ONLY state in the 9th circuit jurisdiction to have this racially discrimatory law is CA. If the 9th circuit upholds this ruling it applies ONLY to CA. We need to get the other 4 racially discrimatory states in line. The only way to do that is a couple more Appeals Court rulings or ONE SCOTUS ruling.

It will be interesting to see if the other states pressure CA to fall on its sword the way CA pressured IL to fall on its sword and not challenge the 7th Circuit.

These rulings are based on previous SCOTUS rulings and we WILL get the result we need eventually.

CA statewide legislation is a mirror of San Diego's. The issue is whether a citizen must "justify" his "need" to excerise a RIGHT to anyone. The 7th circuit has said NO. Heller explicitly states the right to defend oneself extends beyond the home. McDonald assures that ruling applies to states an municipalities.

I look forward to future rulings.

I'm not anti-firearm, it just seems odd to me that there's more than 330 million privately owned firearms in this country. That's one for every man woman and child. That seems excessive to me. I understand it's a right and all that, but I can't think of any other item that so many people own that's only purpose is to kill.

"I have to own a firearm to protect myself from other people with firearms" Makes me wish I was in the firearms business.

Not all firearms are designed to kill. You think a Biathalon rifle is? You think my skeet guns are? You think a trap doubles O/U is? Do you really think Alla's M41 S&W is designed to kill anything? I mean they COULD kill, just as my Bar B Q fork could...but we are discussing design, right? But that is a moot point, of course, and one I would rather not argue because...why?

That said. It is OK to kill people...IF they need killing and IF you are the right guy to do it. GZ v. TM for example (there are others but that ine is well known) And it is a RIGHT.

"Shall not be infringed" means what it says. And I do not understand how most people can survive with only ONE firearm per person. I have more than that in the kitchen!

I agree with you on that. But there is the potential for waste of judicial resources on other similarly aggrieved parties suing municipalities and sheriff's departments. Hearing it en banc would be a way of putting the issue to rest potentially for the entire state.

Better yet would be to lose in the 9th circuit and take it to SCOTUS where it will apply to ALL states. I am hoping for that.

Why would they have to hear it at a bank? That makes no sense.

Crime is down 17% in San Diego since they have implemented CC

Next issue will be nationwide reciprocity for CC licenses. It's in the works.
