Is Adjustment of Status Mandatory on K3?

Timeline

The two petitions will be matched together, approved at the same time (on the I-130 timeline), then the I-129F will be administratively closed at NVC and you will be on the CR-1 path whether you like it or not.

To start with the K3 is obtainable. Being matched? Not necessarily true either. Administratively closed at NVC for K3? Nope. Anyone that wants to apply for a K3 should do it, it may pay off for you. Don't listen to the VJ rumors about K3's being obsolete or unobtainable. How do I know? Last April I filed an I130 for my wife. Last September I filed a K3 because we got tired of waiting. More than one person here on VJ tried to tell me that the K3 was obsolete and that I was wasting my time. In December my I130 and K3 went to NSC. In January they got approved on different dates. Now my I130 is sitting at NVC waiting to be input. My K3 is at the embassy being processed. Is the K3 still obsolete? Apparently not.

Ooh! I hope your k3 goes through! Or at least, as happened to a Jamaican filer recently, that the k3 is eventually cancelled, but they automatically expedite your ir-1/cr-1 through NVC. Either way, FASTER!

I wouldnt wish the K3 on anyone if they have the actual choice of picking one. If I was at the stage where my I-130 was at the NVC and my I-129F was at the consulate (beyond the fact Montreal would have closed the I-129F, as they have done in the past) I personally would pick waiting the few months at the NVC over the K3. Why on earth anyone would think a few more months for the green card over a year more for the green card is a good idea is beyond me. But then, I always felt that this process, despite how much I cried and hated it, was simply just such a small part of the rest of my life, I might as well do it right.

I also think the USCIS is purposely sending the I-129F first so that the NVC has to peocess it. They're mucking about in your life more than they already do. Jerks....

But on the flip side I will tell people that the K3 may be obtainable, however the petitions will likely be processed at the same speed. So it doeant make your wait at the USCIS shorter, but you may skip out on the NVC. At that point you may choose to wait a few months doing document and fee payment to get a green card upon entry to the USA or enter on a K3 and adjust your status, getting a green card in 6 months to a year.

Both require a medical and interview.
