Is Adjustment of Status Mandatory on K3?

K-3 is unobtainable now.

When it was obtainable, then yes, AOS was required once in the US.

Actually this turns out to be not necessarily true for at least one Embassy - Warsaw just issued two K-3s to two separate applicants as it was reported on local forum. Surprising but people posting seemed credible.

Harpa and NLR, thanks for your input. I feel like I have a few options now, at least.

If you file for and somehow obtain a K-3 visa you will be permitted to come to the US. You will have to pay for and file to Adjust Status. Very expensive.

That's honestly not an issue at all. I'll be losing significantly more money by staying Canada since employment options are limited (I can't speak french, but live in Montreal) and once my student loans run out, I'll have to transfer savings money over from Iran (it seems like your husband is Iranian, so you may have some idea of how much that can cost right now)

Timeline

Many Canadians live close to the border and travel to the US every weekend or every other weekend with no difficulty. Being jobless or not in school will up your chances of a denied visit. I visited twice during immigration and had no issues but I was also asked where I worked during inspection. If you plan on visiting a lot, a NEXUS card is a great $50 investment. You're fast tracked through customs (and security in the USA).

If I were to get a nexus card, would I just hand it to the officer along with my passport?

Timeline

I think something that you are missing is the time it would take for you to get the K3 it would be basically the same length of time as the CR1. That is why they pretty much stopped doing the K3's their purpose was to be faster but it turned out they weren't. So you would still be waiting in Canada.

No the procedure is a bit different. Lool it up :)

Fyi, you may be put into AP for a period of time because of your family background even though you are now a Canadian citizen.

When I looked it up, it said that there'll be Nexus-specific machines at the border crossing, but I've never seen them where I usually cross.

Hrm, there is normally a special line up for NEXUS and airline personnel at the airport (NEXUS lanes at land crossings are less common.) Because you have to apply, get a background check then go for an interview, they do a retina scan at the machine and then you talk to a CBP or CBSA officer. The line ups are short and fast because you're a pre-screened traveller. You would still have to talk to a customes officer and convince them your visit is temporary for the USA but as the card is meant for frequent travellers, they really arent as worried. Having proof of your ties is always good to bring even if you are not asked (I never was, but I brought it just in case.)

That's the thing, I always go by land (Greyhound) through the Champlain CBP. I definitely think you're right and it would be worth it to invest in the card, but I just wanna make sure it'd be relevant in this context.
