TAKING A CERTIFIED NURSING COURSE (CNA)

Can someone please help me, i will be copying a pasting a response from an agency here in Sheridan, Wyoming, which I still do not understand the answer to my question with this agency

My wife is here (we married on a K-1 Visa in December) we sent in all the I-485 for the green card processing.

We have been trying to prepare for her employment once the work permit arrives in the mail. She is certified as a caregiver (CNA) in her home country, but here in the U.S. she needs to be re-certified by taking a Nursing Assistant course. I have been researching to get financial assistance for this course for my wife for the cost, which at this time we do not have.

This is the response (below) I received from a government agency here in Wyoming who provides financial assistance to help. I still do not understand or know if my wife is able to take this 80 Hour Nursing Assistant course because she is not a permanent residence until her Green card is approved.

Anyone out there with the same experience or knowledge that can tell me if she can take a course (legally) to be certified as a CNA so she is prepared and ready to seek a job in her profession once the work permit comes.

Hi Ron,
I had a chance to talk with my colleagues regarding a K1 visa status. Here is the information regarding studying:
K1 can study full or part-time for no more than 90 days after entry to the U.S.
PLEASE NOTE: They are also not allowed to apply for a change of status.
I also discussed with our program manager the possibility of funding your wife since, at this time she is not a US citizen.
He informed me that she would need to meet the I-9 Right to Work document verification requirements in order to even be considered for our program.
I have attached the list of documentation requirements.
Please let me know if you will need any additional information.

Timeline

There is nothing immigration wise preventing you from studying while AOD is pending but it is up to the individual school's policy and as far as financial assistance goes you likely won't qualify until you are at least an LPR and possibly not until several months after.

Once you have the EAD, she will meet the I-9 requirement noted. That might be a specific schooll policy as would have a placement office and would have already setup agreements to place students upon graduation (which is a good news, but you want to chek on that).

As for funding, most colleges like this rely on federal or state funding, for which the GC will be sufficient; the funding could be in the form of a loan from the Feds, (FAFSA usually); you want to check terms and conditions of repayment, etc; usually those kind of loans cannot be discharged in a bankruptcy procedure, have predefiend rates, etc. Not the best of deals, but is a good way to get education. The certification your spouse would need is probably not a long program and would need a big figure.

You could try getting this person info about where you are in teh AOS process and estimates of when ED would come in, GC, etc; EAD is usually around 30-45 days of biometrics, GC is almost always a guess; perhaps you can check on the times in teh proper USCIS center and in the timelines here to get an idea. Ours ook about 4 months end to end until GC was on hand, but that is 2-3 years ago.

They might agree on conditionally accepting in the program, based on the EAD being shown within a given date. Since you would be able to present the NOA-1, that might be enough proof that things are moving. As for funding, that might be a bit more difficult because it might be predicted on residency, for which you need the GC. Won't hurt to try.
