Hello,

I am a US citizen. My girlfriend (Russian citizen) & daughter (US citizen by birth abroad+passport) live in Russia. We are not married. My girlfriend has won the Greencard lottery and is awaiting her interview. She filed the DS-230 as "divorced" as per her previous marriage.


How do I come into play in her application/interview?


1) Do I need to file an the Affidavit of Support I-864 form? If yes, then do I quality as a "relative"?

2) Will the embassy find issue with my girlfriend seeking immigration through the lottery vs pursuing a fiance visa instead?

If your girlfriend can't prove her own financial standing then an affidavit of support would be useful.

As you are not married to her, you are not a relative. I can't see that you really come into it at all tbh unless you provide an AOS.

The interviewing officer might find it strange that she is doing it this way, then again he might not, seeing as a DV visa would not leave her open to the potential problems a fiance visa would - this way she is an unconditional LPR as soon as she enters. As long as she meets the criteria (education, medicals etc) she will be granted the visa.

How do I submit an Affidavit of Support form if we aren't married and I'm technically not a "relative"? The language on the form isn't clear, which item do I fall under:

Part 1.
1.a. I am the petitioner. I filed or am filing for the immigration of my
relative.
1.b. I filed an alien worker petition on behalf of the intending
immigrant, who is related to me as my
1.c. I have an ownership interest of at least 5 percent in which filed an
alien worker petition on behalf of the
intending immigrant, who is related to me as my
1.d. I am the only joint sponsor.
1.e. I am the first second of two joint sponsors.
1.f. The original petitioner is deceased. I am the substitute sponsor. I
am the intending immigrant's

Is getting married quickly now worth it to be able to file this form as a "relative"? And since she already listed "divorced" (from her previous marriage) on her DS-230, would our sudden marriage be a problem at the interview?

I don't know much about AoS's - 1d looks right to me but others will know better. I do know that you don't have to be a relative to provide an AoS. Seems a bit crazy to get married just to tick a different box on a form, especially as it's a form which she may not even need.
