Hello,

After my wife and I filled everything and sent the papers, we got a Request for Initial Evidence a couple of weeks ago. Basically, what they are asking for is a letter of employment for my wife with info such as salary, date of emplyement, nature of the job, wages or salary earned.

We got the letter the day after (we were stupid to not include the letter in the first place).

However, another thing they are requesting is "Pay stubs of other documentation of pay for the previous six months".

My wife started to work at the end of september and she only collected pay stubs for about five months (we are both recent grads). unfortunately we cannot wait until mid march to send the new pay stubs because my OPT card will expire at the end of June and I need to adjust my status before that happens.

We talked to a lawyer and we did a lot of researches online and it doesn't seem to be a mandatory requirement. The letter of employment also says that my wife makes three times the poverty guideline and that she has a stable job with future of advancement.

Every time we called the National Cosumer Service Center we got different answers.

We are really confused.

Any help?

What you have should be sufficient, 6 months is just the standard that they ask for, however I'd make sure that either the employment letter or a cover letter you include explains that the position only started at the end of September hence the lack of the full 6 months.

The letter clearly says that she is working there since Sept 21. We are also going to include an additional cover letter where we are going to explain the lack of the full 6 months.

We both have jobs and we are both included in the application. I really hope this six months thing won't affect the final decision.

Don't worry you should be fine, as another poster suggested though the worst case is they would request a sponsor but I don't think that would be likely, it wouldn't harm to try to line one up though.

How are you working though? Are you on a work visa and this is just in the wrong forum? If you're legally working here then you can also use your income.

I am sorry. I may have picked the wrong forum (there are so many I sections I didn't really know what to pick). I am working under OPT (1 full year after graduation).
