Which Senator's are helpfull which are useless??Please help! K1: TODAY 6 MONTHS WAITING FOR NOA2

If you had filed for ESTA and it was approved, then what was the reason for you being detained at the POE? Did they deny you entry and send you back home? I don't think this is any cause for denial, but it seems to have some smoke coming from it.

It was this Visa Waiver Program,..... We say esta here too.... I stayed two months with him the first time because I didn't had a job in the end of march 2013 anymore! My company was getting bankrupt in the end of january 2013 but the working contract was still going until the end of march 2013! So I had no job anymore and shortly before I left germany, i cancelled my apartment because I didn't wanted to stay anylonger in this city, that I was extra moving for, because of my job! So it probably looked to them like We had the intention to get married and then I was only after 84 days in the US for two weeks in Germany, to visit my parents! And wanted to come back to see him after this two months and that was probably to short this time! Not prpbably, NOW I know it WAS definitely to short, but I didn't researched enough or anything about this BEFORE I flew back to see him :-C Edited by Trisha89

Really I'm not just saying this and I know he is not lying to me, what you maybe think now..... But he is my age 24!

We have nothing bad in our past. :-C

I'm sorry if my wording is not appropriate. I'm not saying he's lying to you. USCIS more focus to do background checks to petitioner for this stage. After approval and case file forwarded, the US embassy in beneficiary country will do background check for the applicant. That's why even though some people got approved for I-129F but they got denied for K-1 visa.

I've read a lot cases here why took so long for their I-129F process. Some of them, their files went missing, or some others because of the petitioner background checks. I think you're in the right way started inquiring your case file.

Did you work at all, or look for work while you were in the US on ESTA? Were you working in Germany or the US during early 2013? Anyway, you're right about how it looks. There are very close and confusing overlaps in where you were living, where you were working, and then finally filing for K1. You're probably fine and have nothing to worry about, but the folks at the USCIS are probably trying to figure out your travel timelines. You said you were detained four hours at the US POE. Why? Did they send you home and deny you entry?

You can call the Service Center and speak to a specialist. Explain your situation and that you would like to speak with a supervisor. My experience with them has been very positive, just be patient, polite and persistent. You can call everyday if you don't get an answer you like or a solution. It's your right. Make sure you register to get email and text updates. There is a 60 day maximum time limit. They have to give you a response whether it be positive or negative.

I know we will get to hear something from then and when it's a message that they lost our case, but oh dear I hope they tell us any time soon then as letting us worried here the whole time :-/

By the way our wedding (if there ever will be one, WHAT I HOPE AND LOOK FORWARD FOR) will be in Key West ;-) just saw you are living there now since a few days... :)

Our case was held up for 8 months for a few reasons I will list now.....

First was held up 6 weeks because they never actually sent the RFE they issued when they should of done and only sent it after we had a INFOPASS.

the next 3 months we was held up because I had a B2 denial and they had to wait for the US embassy in London to send it to the DOS and the DOS to send it to them so they could check why I was denied.

There was also another slight hold up cause they was checking my fiancées divorce degree.

This is what I was told by the congresswomens office that was helping at that stage.

NOA1 - APRIL 19th

RFE - SEPTEMBER 3rd

RFE REPLY - SEPTEMBER 11th

NOA2 - DECEMBER 20th 'approved'

NVC RECEIVED - JANUARY 9th

MEDICAL - JANUARY 24th

I NEVER sorry but I never looked for work while I was in the US!!! I wasn't falling on my head that I know what you can do and what not LOL!

I worked from february 1st of 2012 until the end of march 2013 as Flight Attendant for a german company that was getting bankrupt!!

I know it looks strange to them, but what can I do?! That is all how it was and I have nothing to hide about it! I love my boyfriend and just wanted to spend time with him and since I didn't had a job anymore we were thinking of me staying there longer, because my stay would have been only from march 25th, 2013 until april 7th, 2013! So we decided while i was there that I stay longer there with him and don't fly back home after the 7th of april and search immediatley for another job in germany!!!..... I know it sounds complicated and it maybe is, but it was like I said it and i wouldn't talk about it at all, If there would be anything not like i said it here!

And YES after this four hour interview, they were putting me in a room for 22 hours in the airport building and after 22 hours I had to fly back to germany without seein only one time my at that time still boyfriend!

We talked about getting married yes, we knew we love each other more then anything and that we want to be together BUT NOT WHILE I AM THERE AND I AM VISITING! I'm much to scared to do things like this, because I KNOW it is illegal when you do this! So it was from the beginning for us always for sure that we want to di the K1 process, probably we would have started after this two months IF I WOULD HAVE SEEN HIM THEN!

But we didn't saw us so we were getting an immigration lawyer for 1.500$ and he was helping us with filling out the papers and when my fiance visited me in the end of september / beginning of october he proposed to me! (October 5th, 2013)

I'm hoping it just something that your case file piled up on some adjudicator's desk and not because went missing or USCIS is suspicious on your petitioner. Many people get accused for something that they have never done before.

Yes, my wedding is coming up and thank you for looking out for me. Meanwhile, I am waiting a positive news from you near in the future on VJ about your I-129F. Cross fingers for both of you, guys!

Trisha, thanks for writing more details about your experience. You seem like an honest and sincere woman. Our US border people can be real dicks sometimes. It must have been so difficult for you to travel so far and get turned around and go home without seeing anyone.

There is no way to know what the border agents wrote about you, but regardless I think you surely will be approved and be able to be together with your partner. I wish you both the best and for the sake of both of your hearts I will keep my fingers crossed for a speedy approval. I think it's probably coming soon for you. Good luck.

Thank you really so much for your true words! It is so needed and gives me the power to keep going on! It is really not so easy how it maybe looks to other people. I am thanking all of you here for your help and giving me some thinks that maybe could be the reasons why we are still not approved...

Our I-129F in 2012 took 8 months, I don't think that is abnormal for an I-129F. Unfortunately there will always be people who take longer to get processed, you just happen to be one of those cases. You can scream and complain to high heaven, but no one, not senator or USCIS is going to take you seriously because 6 months is nothing.

I think I have ALL Reason to scream and complain! more as people that wait here one or two months and whine because of this!!

Ok so people that wait one or two months they can do or what?! Sorry ridiculous! I don't try to fight against you, but you are telling me u cancelled the i-129f? After 8 months? Or how was it going then with your I-130?

Or did u waited 8 months for the I-130? I think just because you waited two more months as we did right now you can't lean back that much out of the window! It is really a hard process enough already and people like you just try to make it look easy but IT'S NOT! And normally all people who can think will feel the same about this!

Okay so i completely understand what u are into right now . We all know that there is some people get approved in short time and they have no Good Evidence of reference but still getting approved in short time . That's just ridiculous and stupid . BUT as one guy i used to know said "It's all about luck" they don't care about how clean u are or what did u do in life or anything . Of course of all us here and "i'm sure are clean and have clean criminal history" and have relationship for a year or more or anything . in the other hand there are people who just send a "K1" with one trip and getting approved over people been in relationship for years or months .... There is no other explanation than "luck"

It is very sad to be away from the one you love . And i'm gonna tell u smth . we been in relationship sense October,2012 with serval trips and got married and submit our file

In the normal view . We should get approved quickly bcz were both clean no criminal history none of us were married before a year and half relationship, letter from freinds, familly ...............

But who cares , This is life .. If u are lucky u don't need all these evidences , if ur not u gonna struggle just to be next the one u love :D , sorry that i make it so long , i'm just missing my wife terribly .
