Hi guys we got the RFIE letter and they need my moms current tax year taxes and my dad's since they are joint sponsors. My question is her company for her student loans advised her over the phone to not file this year so she wouldn't have to pay her loans back. But we need 2013 for the I-864. So what would be best to do? I had included a written explanation on why I didn't have taxes for 2008-2012 and that still wasn't good enough so I'm thinking they don't want letters just w2s and the 1099s. We are stuck help please!! ???

Tax avoidance is a felony, so she can't just not file them to try to avoid paying student loans, which would put her in even more trouble.

However seeing how the deadline to file 2013 taxes has not passed yet (April 15th) you should be able to provide the W2s along with proof of current income like payslips and a letter from her employer.

My guess is what the loan company told her was something along the lines of "we are going to take your refund but if you don't file taxes we can't take it." Unless she meets the very stringent requirements to have her student loans forgiven she will owe them until she dies. They will even take her social security to pay the loans back. Is she in a forgiveness program that will forgive the remaining balance on her loans?

My advice, have them file their taxes either married filing separately or have them file jointly with your father filing an "injured spouse" form. This way they won't take any refund that would be due to him. Either way they are required by law to file taxes.
