Hello to everyone who is going through the same thing as me and many others.

Been 5 months Ap still no answer. Called VS and they said nothing was sent to check on the beneficiery. Its the embassy taking too long. I dont know what to do. They said all his papers are correct and theyve had his passport for the past 5 months. Its been since September 2013. My Consulate is in Lome,Togo West Africa. No one is helping or answering anything.

Call up your senior US Senator and get their office involved. Unfortunately there's not a whole lot you can do about AP :/ Tell the Senator's office to start enquiring weekly for you.

I-130 Sent: 11 November 2013

I-130 1st i-797(NOA-1): 12 November 2013, Vermont (Dis-)Service Center (1 day in transit)

I-130 2nd i-797(NOA-2): 30 May 2014, Vermont (Total Dis-)Service Center (199 days in USCIS hell)

I-30 Received at NVC: 11 June 2014 (11 days in transit)

NVC Case # Assigned: 27 June 2014 (15 days to case number assigned)

DS-261 Completed: 15 July 2014 (18 days to DS-261 available)

AOS Fee Bill Paid: 17 July 2014

AOS Fee Bill Shows "Paid": 22 July 2014

AOS Package Sent Out:23 July 2014

AOS Package Recieved: 28 July 2014

DS-260 Completed: ?

That's odd, usually they let the beneficiary keep their passport up until they are ready to finally issue the visa. Do they not want him to leave the country?

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I dont know. Our lawyer said its a good sign that they kept it but its been too long. I dont beleive in lawyers they just want money but my husband wanted everything to be correct

Ok first of all relax please. I have been through AP myself and was freaking out as much as you are if not more. Your lawyer can't do anything so please keep the lawyer out of it. If someone tells you to include the congressman dont do it coz it doesnt help. I involved the senator so I know. Here's what you need to do. Send a follow-up email to the Embassy every three weeks. Based on my experience, most of the cases are resolved within 6 month to a year. My AP was completed in 364 days. The maximum it can take is two years but it is very rare. 80% of the cases are resolved before the one year mark. Once it is completed they will contact you if they need any additional documents and your visa will be issued.

Don't confuse yourself with millions of opinions. I've been through it so letting you know. thanks

I hope it gets done when hitting the 6 month of Ap i just cant help it its nervewrecking and frustrating.

I completely understand what you're going through. Trust me, all you have to do is be patience. It will be processed soon. Let them do their thing. They do complete it within a year mostly. All the best :)

hey there.....seems like this AP is like a never ending process for all of us....my husband's case is under the same process and we been waiting each day with utmost hope that it happens soon Insha Allah...

its just not in our hands but be patient....keep praying and be hopeful!!

Yes thats what happens with me and hubby. We wake up everyday hoping a change but no. But elhamdella for everything and inshallah it will be soon. And hope your hubby gets his visa soon

It isn't normal for them to keep the passport for such a long time. In fact, I have no doubt that the State Department has polices about this, and keeping that passport for 5 months while you are going through AP is most likely counter to those polices.

You should be able to force them to release the passport, until they are ready to actually issue the Visa. It just doesn't make any sense to keep someone's passport for that amount of time - even a month is unreasonable to me. What if the person needs to travel?

Also, that passport is the property of the country that issued it, not the U.S. Embassy holding it while you are in AP. There is no way they can legally keep it during that time.

You should be able to force them to release the passport, until they are ready to actually issue the Visa. It just doesn't make any sense to keep someone's passport for that amount of time - even a month is unreasonable to me. What if the person needs to travel?

Yeah its been too long but were waiting...you actually can get your passirt from them and when theyre done theyll call you back
