Will I-130 be approved with court date in Immigration Court pending? (split topic)

Dear blueberry

I entered the united state in september / 2011 with a B2 visa, i stayed here till today i used to live in new jersy and there i met my wife she american citizen then i moved to grand rapids, michigan with my wife in July - 2013

In august / 2013 a police arrest me for a driving without a license. And they put immigration on hold after that sent me to immigration jail in battle creek, mi my wife hired i lawyer and they released me with 3000$ bond they filed the i 130 in sept. 2013

Do you think they will aprove my i - 130?

by the way today i had a immigration court to cancel the deportation but they reschduale the cort date to november - 2013

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

The I-130 is just a petition, it doesn't provide any immigration status on its own. Do you also have an I-485 filed concurrently? That would grant you a pending status and allow you to stay until it is decided and any over stays are forgiven when married to a USC so unless there are other circumstances that you haven't disclosed then you should be ok.

However it seems odd that you ended up in immigration court just from an over stay and a driving without a license offense.

Not really, it's one of the most common way aliens unlawfully present wind up in immigration court, through being picked up for another infraction and then being placed under an ICE hold.

Yes, I130 can be approved. But you can't do AOS until the judge remove the deportation order. It should be an easy case for an experienced attorney who did these types of cases. Usually, judges remove the deportation order as a relief for immigrants who got married newly to a USC. But the most important now is not the approval of I130 , it’s that you get rid of the removal order. Good luck
