Timeline

My husband interviewed on December 12th. How much longer do we have until his file will be sent to NVC and for me to hear from USCIS? Am I correct that if he is reaffirmed that I could possibly not receive any notification it could just be returned to Lagos for the second interview. I guess I am asking for a guestamate on how much longer the wait will be I am trying to plan on being there before his next interview so I was trying to figure a time frame to make sure I have enough time to get there...

Assuming he was denied at the interview, it usually takes around six months for USCIS to re-affirm an I-130 (or issue a NOIR).

No you would be notified by USCIS of a reaffirm. If its a revoke or Deny (NOIR or NOID) you will get a letter and the denial points listed and you would have to submit evidence to each point.

It usually takes 4 to 8 months for the petition to even get back to USCIS. Than its whenever they get to it. Than they review and render a decision. But they do notify you.

The usual reaffirm goes like this (whether you are asked for evidence or not) usually 6 months to a year it will be reviewed by USCIS. Than if reaffirmed sent back to embassy for interview which can take another 3 months.

Since you had interview in December maybe by summer (June or July) you may hear something.

Remember the service centers are beyond backlogged. I doubt your petition has even left Lagos. Have you followed up with congressman? They can get the diplomatic pouch number and at least know the whereabouts. The embassy won't tell you where your petition is at, but they have to tell the congressman. That's all they can do is get you the information. I would call tomorrow for that if you haven't.

Of the 3 reaffirms I know of for Lagos:

  1. denied October 2012 file back at USCIS, June 2013, Reaffirmed August 2013, Interview December 2013
  2. denied November 2012 file back at USCIS, July 2013, Reaffirmed September 2013, Interview January 2014
  3. denied February 2014 file back at USCIS, June 2014, Reaffirmed September 2014, Interview January 2014

No problem. My pleasure. Now the time frame in all honesty from denial to second interview should be about 1 year. Its the dang petition getting here thats the most longest time. And no one can give you a straight answer.

But do keep eye on the uscis.gov site and your petition and watch updates. Cuz now you have gone from DOS to USCIS. OMG these acronyms.

And you are never bothering me sweetie.
