They didn't accomplish marriage fraud. USCIS caught them out, and they were being referred to a Stokes interview they would surely fail. Then, at the end of the article, if you read it, she says that the guy won the diversity visa lottery so they abandoned their marriage application.

So, USCIS caught them pretty easily.

I do wonder, though, why USCIS did not pursue allegations on the old application while doing the new visa lottery GC. But, I suppose if it was withdrawn they had not conclusively proved the fraud, yet.

I don't think this is a good case to testify for marriage equality because the guy did not have a boyfriend or partner he wanted to stay with. He just wanted to live in the US because he wanted to. His sexuality was not the issue, as I see it.

It was, to a degree. He's from the middle east where its not looked upon well to be gay. He liked being an out gay male, which was impossible where he was from.

If he had shown her his ####### they would have been all set. She couldn't answer the question.

One of my best friends from HS who lives and works in the ME by choice with his husband has said, and I quote "It's way easier to be gay in the ME than in the US."

Yes, and I have friends who have worked over there and talked about how they had to hide it and be extra careful so they wouldn't get arrested in some areas. I'm sure its just like the US.. Its easy to be out in NYC, not so much in Alabama..

They didn't accomplish marriage fraud.

That is a VERY liberal interpretation of their situation. It may have ended well due to the lottery, but they DID commit marriage fraud for the purpose of obtaining a GC.

as in you don't actually have to succeed in robbing a bank to be charged with bank robbery

I said they did not accomplish it. I did not say they didn't commit it.

Yes. I am very much against marriage fraud. They did bad, wrong.

What I was trying to say, is that USCIS caught them and it would not have worked. They did not succeed in their fraud. So it is a testament to the fact that USCIS does know what they are doing.

I then wondered aloud why this didn't affect the DV lottery visa.

Anyone else want to try to twist my words and misread things?

If she had seen his #######, they would have succeeded. He should have let her check it out even though it would have given him the willies having a female fondle him.
